Who is really at fault?
« on: July 23, 2012, 09:26:24 AM »
Saw this video, and as much as i appreciate how calm the people are I think it could have been totally preventable. In the comments everybody says they would kick the truck drivers ass for making an illegal  u turn (like there was somewhere to make a legal out in BFE). IMO when riding a motorcycle it doesnt mater what is legal or illegal or who has the right of way. All that maters is staying alive and avoiding situations that can kill you even if you are in the right. SO for me watching this video as an armchair quarterback as soon as that guy pulls over im thinking " what is this jackwagon doing?" that would prompt me to slow down. If he wants you to pass he will wave you on otherwise i proceed with caution. Luckily this guy has good reflexes and knows how to brake.

It's a good mix of blame, but I'd say the driver in the end.   Doing a U-turn like that, you want to make sure there's no one in your way in either direction, and he didn't seem to slow down long enough to check both.  That being said the biker was very slow to recognize the truck was stopping and pulling off to the side a bit, which definitely would've made my Spidey-sense go off.  He didn't get the brakes til the last second.

The driver should have looked a little harder in the rear view mirror but the bike was getting faster and faster.  I would say both are at fault.
I don't have a motorcycle, sold it ('85 Yamaha Venture Royale).  Haven't had a CB750 for over 40 years.

Oh, I think the driver is at fault but when your life is on the line it doesnt matter. If he kills you for his mistake he will have to pay the price but your still dead. :-[
Stay safe!

Id have to agree. As soon as I saw the truck on the side of that road, I would've slowed down. I can't believe he stopped like that with knobbies. I would've shat myself!

truck driver's fault compounded by motorcyclist's lack of awareness / caution.

I would call it a toss up.  Driver should have looked better but bike was moving fast.
Funny I had some a$$hole do this last week on a 4 lane street.  He knew I was behind him but did it anyway.  He dam near hit a van too and think the guy in the van would have backed me up to go after him.  I know I've seen the car before and it will turn up again.
