Mick, I wouldn't close the case until you have received the funds.  After that both parties accept the resolution and no harm is done.  I would give the seller positive feedback because they did resolve the problem to your satisfaction.  Something like, " there were defects in the merchandise but the seller made restitution to my satisfaction"...Larry

Yes, thats the plan Larry, the problem now is that he can't put the money into my account because he says ebay has frozen his Pay Pal account, i have told him to use the help function and contact ebay then let me know what they say...

Mick - only close the dispute when the money is in your hands never before. In fact before it gets to 45 days, make sure you escalate the ebay dispute in paypal to a claim so he cannot get away with ripping you off. Even when he has done this, still give him negative feedback but keep it factual. What a jerk! It sounds like on the postage fees he's hiked the actual postage cost by enough to cover the ebay and paypal fees out of your pocket. People like this should be removed much quicker from ebay.

I had a similar situation a year ago but through a ducati forum. A member offered to sell me some parts which I paid for through bank transfer. He then ignored me for three months until I threatened to take him to court and a refund appeared. Same username was on ebay and he was getting 20-40 negative feedbacks PER DAY ut it still took ebay a year to remove him. Sadly, as long as they are making money through sales I don't think they care too much about the integrity of their sellers...

Mick, You should check with EBay about this also and not trust what he's telling you. Don't run out of time with his delays. May be legit but you won't know until EBay verifies.
As of today 3/13/2012 my original owner 75 CB750F has made it through 3 wives, er EX-wives. Free at last.  ;-)

Thanks guys, it ok, i am not ending any resolution till the money is in my account, i have told him that and haven't heard from him since, 2 days now. I am about to send him another email through ebay informing him that this will become a claim and will be worse for him, if he does not make the transaction before the 14th, which will be the 13th for him as the dispute was done on my time, not his...

Ok, he has finally put the refund into my account, paypal has verified it. Ebay is still telling me to give it till the 15th to make sure the payment is valid or cleared, is this usually what happens..?  Should i leave it till the 15 before ending the resolution.?

My paypal account is only through my credit card, so if the payment was made {i have confirmation from paypal} then its in there, i will not be ending this till the 15th just in case...   Then on to feedback.... 8)
