As it turns out you guys were correct about my needing a lawyer. Not to protect me from the other guy's insurance company but from the hospital. The insurance company paid off on the DAMAGES to my bike: $5125.75. No calling it totaled, no salvage title, no asking me to sign off on the personal injury claim. The hospital however refused to send me a bill, called repeatedly then after only three weeks sicked their lawyers on me with letters and phone calls saying that I had been refusing to return their calls etc. I hired my own attorney who pretty much fixed the whole situation with exception of my right knee which has a torn ACL. Which brings me to why I haven't posted much or updated this particular thread.
On May 23, I was on my CB360 headed to see an orthopedic surgeon and a pedestrian stepped out in front of me. He was cutting through traffic that was backed up to make a left turn, looking at his phone and he stepped right out in front of me. Less than a car length to react, I dodged left and if he had kept moving, I'd have missed him. Of course he froze and I ran right into him. His tib/fib were shattered, facial injuries, and somehow he ended up under a parked car. I was thrown off and tumbled/slid across the road. My C3 vertebrae was broken, my cervical spinal cord was bruised and it swelled up causing me to be paralyzed from the neck down. I had on all of the right gear so my head didn't get busted open, no road rash, no other broken bones.
