Will It Never End?

      A good number of you, know what my (so-called) brother (who I will, from here on out, refer to simply as david) and his wife had put my Dad through a few years back.

     Well, (I don't think I have revealed this yet) after my Dad's passing, my Wife said that we really needed to let david know. Well, I did not want any part of having to see him, much less talk to him. But, I figured I would have to be the one to do it and I don't know his phone number. But, Michelle (my Wife) told me that she would do it, as she didn't want me to have to deal with him. I didn't really want her to do that, but she insisted. So anyway, she went over there, knocked on the door and stood back somewhat. david opened the door, told her that if she had come to tell him about his dad passing, don't bother! Then went on to say that it was a good thing I hadn't come, as he would have broken me in half! An, as he told her "It isn't over", he slammed the door in her face!        Even, after my Dad passes, he just can't give it up! I have no idea just what he thinks he can accomplish. Previously, when this originally started up, I got my Dad a lawyer (one recommended by a couple of lawyers, who my Dad and I were once in an Army Reserve Unit with), as he asked and my Dad told the lawyer what he wanted. I simply took him to the lawyer and my Dad wanted to make sure that I received the home where he and my Mom retired to and passed everything he had, down to me, leaving david with nothing. david was mentioned in the will, with my Dad leaving him with his love and affection and the lawyer setup deeds to his 2 properties, in such a way that if something happened to either of us, the survivor would retain full possession. And everything we did, was filed at the courthouse, as per the lawyer's instructions, even the Will. The lawyer said that we had done nothing under the table and that would prove it. So, that was how it was done.

          Now, this has me wondering. Michelle and I went to the little VA office in our little town and was told that we were the 2nd Van Pelt to come in today! Well, david had been there and I can not figure out what he is up to. He did not finish his 20yrs, to get his retirement. I think he did something like 12yrs or so. Anyone have a clue as to what he might be entitled to? We are wondering if he might be looking to see if he is entitled to get anything because of my Dad's death? I could be wrong, but knowing the way david operates, he will bust a gut, trying to get what he doesn't deserve.

         As usual, ANY input on this thread, is greatly appreciated.

A valid will will is a will. He may try to contest it, but he'll have pay a lawyer to do so. Does he have the $$ for that?

VA education benefits can be transferred to family members.  Can't think of much else at this point.

          Bob, I don't know how he could pay for a lawyer. They managed to get a lawyer twice before and always came out on the bottom. AND, the 1st lawyer ended up dumping them, before getting started good! What does THAT tell you? Apparently didn't sink in to david's puny brain. I had previously contacted the Sheriff's Dept. about them and that I had a bad feeling about trouble, knowing david. I was told that since "they know they aren't supposed to be there, if they even set foot on the property, call 911"! He said, don't wait for them to do something, then they will be told to leave or they will be "escorted". I will be so glad when we can get on with our lives and not have to wonder.  Also Bob, I told the lawyer, after I had set up 2 witnesses and a notary public with my Dad, so it could be read and signed with the witnesses and notary, that I was a little nervous about that will. The lawyer asked why and I told him, I had seen cases where it was taken to court and the judge ruled that everything would be sold and the money be split among them. The lawyer then said, " Bill, think about how I asked you to get 2 people to witness, who had nothing to gain, had a notary public and had YOU step outside the room, while your Dad read the will, signed it and it being witnessed by those 2 people and the notary. You were no influence and those 3 people were saying that, on that day, at that time, your Dad knew exactly what he was doing. Not to mention that myself and the other lawyer (a friend of my Dad's and mine, being officers of the court, are bound to tell the truth and that they both KNEW my Dad was fully aware of what he was doing (not to mention that the other lawyer, could verify, from having known my Dad for quite a few years, that he was aware of what he was doing too. david was mentioned in the will, but all he got was my Dad's love and affection.

         I hear ya, Larry. But not thinking of him, with him being a pain in the butt, is not easy to do. There are things in this house, that he wants, BUT, There IS the matter of there $7000 check that his wife wrote on the account, so they could pay off david's bass boat. In getting ready for that hearing, I had found a check register that showed his wife had written that check and I went to the bank and got a copy of that and gave both items to the lawyer. When questioned about that check, She was pretty surprised that we knew about that check and said it was going to be repaid, with her making a payment the next month. But, there is really no proof that she did. She did say that she hadn't been able to pay any more on it. The judge asked where this bass boat was and was told that they had it. I thought we might end up with that, but we didn't. $700 is a lot of money, but Dad and I said that that would be forgotten, if they would bring my Dad's minivan and Dakota back to his driveway. they never did, but I found the truck, at a local garage out ion the country and went out and picked it up. Never got the van back. But, they had left some gas in the Dakota and it had sat for a couple of years, by the time I found it and didn't do it any good. I figured the minivan would be the same way. I just want it over and done! I am tired of his crap and want it finished, letting my Dad Rest In Peace and just letting US get on with our lives.

  Well, see, I didn't know that. But, I would think that nothing can be done, until a Death Certificate is issued and those are coming to me. So, I guess time will tell.


  I DID feel like I should stop by the Courthouse, like I did so many times, when this was really an issue and found that they hadn't filed anything there. At this point, I am really thinking that they don't realize all we have done and filed at the Courthouse. Hopefully, he will get a reality check and get on with HIS life, instead of trying to take from someone else.

I told you I had a bad feeling about this.

        That you did, brother. And I guess I should have known he hadn't completely given up. I just can't figure out what he thinks he is going to accomplish!

        But, know this, all he has to do, is to set foot on the property and he Will Be Escorted by the Local Perry Sheriff's Dept. And his destination depends on his attitude, when he leaves. If he agrees to leave, no problem, but if he is hostile, it's downtown buddy! His decision, I'm tired of fooling with him and the Sheriff's Dept. ain't  gonna take no crap!

           david IS a mental case, that's for sure! Maybe ought to have HIM put in a Nursing Home for a spell and see how HE likes it!!!!!!   >:(

Has the relationship with him always been strained like this over all the the years growing up and into adulthood or just got like this when your Dads health started to decline several years ago.

Maybe getting over paranoid but you might want to be careful what you say here. You said you never figured out how your niece found out about your dad's passing so soon because you told funeral home and others to keep quite about it. For all we know she may have been clever enough to find this site and spotted your thread about it. It's a long shot but still very plausible especially considering how far out of their way you say they go to cause trouble.

       It has been strained, for some time, just got worse when my Dad called me back in '06 and asked me if I would be the executor of his estate. So, in Dec of '06, david called me, talked for a bit and then just flat out asked me if Dad made me the executor and I wasn't sure if I should tell him, since Dad hadn't, but said yes, he did. The conversation ended shortly after that and then, in early '07, Dad's oxygen level was low and he wasn't thinking clearly and david & jan convinced him that I was stealing from him and so, I was replaced by jan.  Now, to better show the relationship between david and me, in Jan of '79, after I was to return from a 2 1/2 month Power Generation course in Ft. Belvoir VA, I was supposed to step into the Motor SGT slot in the Army Reserve Unit I belonged to (and david did too). What I didn't know was, while I was gone, david tried his best to cheat me out of that slot and get in there himself. He was MAD when I came back and was placed in the slot. Yeah, nice huh? Then, a little while later, our Motor Officer was being promoted and would be over the entire S-4 Operation (which included the Motor Pool) and I found out that david was trying to get an officer buddy in that slot, so HE could then work him way into the motor sgt slot, but his efforts with that officer failed and he was going after another officer to try for it. So, I went to our present Motor Officer and asked who had input on who the next Motor Officer would be and I was told that I DID!  So, I asked for the officer who was already working with us and was told by the Motor Officer that this officer didn't want it. I asked, who told him that and he rep[lied that "david" had. I told him to stay right where he was and I would bee right back. I found our officer who was working with us now and asked him if he would like to be the next Motor Officer and he said he wouldn't mind having a shot at it. I told him to stay right where he was and went out to tell the Motor Officer that the other officer was in the motor pool office and he needed to go talk to him. So, the Motor Officer went in, talked to the younger officer. That officer took the Motor Officer position and david was so mad, he transferred to another unit the very next month! So, how does that sound?  This is the way my brother has treated me for some time. He ALWAYS thinks HE is BETTER than anyone, at anything! david has had issues, for a lot of years and will never be satisfied. Just like he was set to get half and that wasn't good enough, he wanted all.

           Hey John. you know, I really don't think david realizes what all we did, back then. Everything we did, was filed at the court house and available to the public, even the will. And if he or that idiot of a wife would have ever checked, they would see that the "t"s are crossed and the "I"s are dotted. I don't think they have ever been in there, except when they tried to get guardianship of him. I will definitely keep the lawyer aware of everything though, as I know it. Thank you John, for your input here.

       I figured out how she found out about it, there are several funeral homes under the same company name, in the area and someone, from the one that is actually connected with the cemetery, told her. I am not saying it's not possible, but they just aren't very smart. At least not as smart as they think they are.  Thank you for your input and concern, I WILL try top be more careful, shame SOHC4 can't limit post to certain groups, like Friends, Family or whatever.
