Can someone verify that this frame tab is bent?

Looks bent. Just bend it straight. Would help if you had the seat to test.

Shave it off. Looks like a lot of extra (and bent) weight that is slowing the bike down!

Looks bent. Stick a long bolt through both tab and bend it back

lol exactly what i was thinking. I was going to mod my stock seat pan, but maybe not.

like the standart seat..to open and have somthing safe dovnunder and fuses are easy to get to..

I was looking at the second picture and to me it looks like the Weld at the back of that frame member has something going on that doesn't look quite right to my untrained eye.  If it were my project, I would look at that weld real closely to make sure there is nothing wrong.  I would also be checking the frame in that area for straightness, etc.  I have no clue how that tab/frame section could have been bent like that, but in my mind, the force necessary to bend that tab seems like something else would also have to be bent.

I'd bet one of the pins fell out and the PO didn't care too much. Opening and closing on one tab could possibly bend it like that. I'd just bend it back. It's not like it's a structural thing.

It does look like some odd corrosion or something visible from under the weld - and there shouldn't be any "under" with those welds.
The seat hinge is made from thick steel and it takes a nasty whack to bend it. Either a crash or some weird accident in storage did that, the seat would have been mangled when it happened. Do you see any other signs of damage? I have seen frame straightener rigs pull welds apart when a badly tweaked frame is realigned. The shop I worked with years ago always did an inspection for that, and repaired any weakened welds after straightening. I don't know if anyone even does bike frame straightening any more, you can't do it with modern aluminum alloy sportbike frames.

I see a impact mark on front edge of the hinge that is bent up.
 I would avoid using bolt to straighten it out.  Rather put a bolt or pin in the hole then use maybe block of wood and a hammer, to straighten..or failing that, use an 18inch crescent with shims padding the hinge, if needed to change the angle
  That's if you haven't decided to zip it off.

Use long bolt to line up the holes as you bend the hinge, not using the bolt to bend the hinge, use something else to bend.
