The cager was totally at fault, and "I don't care" negates any other "justification" he may have had.  But....

Those riders are of the type making the rest of us look bad.  Clearly, the dude with the camera was totally breaking the speed limit to catch up with his friends, and when he did, they decided to take off.  There was clearly places where there was passing zones, and just a little patience would have netted a situation where the riders were breaking no laws. On the other hand, even if they were in a passing zone, I believe the cager would have still done what he did.  My guess is that because of the double yellow line, the asshat driver somehow felt justified in doing what he did.  He might have thought differently if it was a passing zone.

There's a time and place for everything.  When the camera dude was catching up was that time and place.  Speed can be "allowed" where there is no other traffic.

Like Stan alluded to there were a lot of wrongs on all parties parts here. To say the rider that got hit did nothing wrong is not correct. He should have waited until he hit a passing zone, passing over double yellow is not legal no matter how you wish to paint the scenario. And when you are passing you need to leave plenty of room in case something like this happens whether it is intentional or not.

That being said I hope the cager gets the book fully thrown at him under the extents of the law.

Well, we have completely hung the driver of the car on this forum. And he was wrong in his actions no doubt about it. I am wondering why the cycle driver would put his girlfriend passenger at such risk. Must not care much for her??? If he wants to drive reckless then do it solo and not with his girl on the back. Both drivers made bad choices on this one, but obviously the biker and passenger got the worst end of this deal. Sad to say that is how these things usually turn out too.

Okay, this story just keeps getting better. I'm just trying to find out if the girl had her hand amputated. There was some question if she was going to be able to keep it.  And then, I saw this;

This cager is a piece of work. After reading this last article, I doubt seriously if a passing zone would have made any difference.

Edit; I just saw a reference to this incident on the NBC Nightly News, in the story of the today's road rage shooting.

I don't think I would've been able to keep my cool had I been the camera man.

Even though I live in a state with no citizens arrest allowed by law, situations like that just make me want to forcefully detain someone.   >:(

I forgot that this happened in Texas (as in don't mess with . . . ).  They might just hang him (but not by the sack).  ;)

This reminds me of Mike Corbin, of Corbin Seats. He was riding his Beemer to work, and someone was off his meds, and decided that Mike(as a biker) was out to get him, and ran him off the road.

I had a driver swerve into my lane while I was passing in1994. Unlike these #$%*s, I was ready for it.

Passing in a double yellow is entirely irrelevant in this case. At fault driver was traveling same direction, there was no oncoming traffic, the road was straight and level with clear visibility. Whether some government goon decides to paint solids or a stripe makes no difference. It was a safe pass from what I can tell. Personally I don't pass when not legal, but legality has nothing to do with safety or in this case fault and liability for compensation of monetary and other damages.

Whether there was a wasp or spider as the at fault driver has claimed is also irrelevant. The man did not maintain control of his car. If if was a legal passing zone the outcome would have been the same. If there was a compact car full of infants coming the other direction at that moment the outcome would have been essentially the same but with a different set of victims. This guy failed to maintain control of his vehicle and caused property damage and injury to someone. He must make the motorcyclist and his passenger whole financially and compensate them appropriately for injuries and wasted time from this. If his actions were intentionally and malicious then perhaps he should be put in jail to protect the rest of us.

I believe his history confirms that he did it intentionally. And I also believe that the double yellow made the cager somehow more justified in doing what he did. So, it would seem that following the law might be the best idea.
