But really I have tried recently to adopt a more "British" senseability to my responses. As Americans we swear in a way that would appal most. The Brits are nicer when they swear  ;)

Brits can tell you which way to go and how to get there, and when they are done you are happy to have that information ROTFLMAO  ;D

Oh, by the way I SUCK at what you do! I stopped doing weddings about 30 years ago...as I always said "Too many fat ladies"...They always want to look better than they do...Oh! wait a minute, that's what you're dealing with right now!

I'm a hobby photographer at best. Over the last year, I have shot really nothing but photos of my then pregnant wife, and now my nearly 5 month old daughter. I took some photography courses in college when I was getting my BFA. Someone asked if I would shoot a wedding. My response... "No way!"

I recently went to a Photoshop seminar. The instructor/speaker, who is a photographer/writer/Photoshop master called wedding photographers "Combat Photographers."

If you are not being shot at you are not close enough. :D

On the "Too Many Fat Ladies".... It is amazing what streching and resizing a pic can do. I had to "Laffy Taffy" one clients pics 15 pixels! so she would not kill me.  :-\ ;D

Tom, your reply is very well explained and it tells a lot about how professional you are at work. It was not the subject of discussion in my reply.

With my long post I just wanted to point out that you have to be professional, but you have to look like one too. The woman I talked about didn't seem to be -in my opinion-, and therefore i couldn't trust in her for such an unique opportunity. The man looked more professional, because even when it doesn't take so long to get the equipment ready, the first thing he told me was that as I was calling him out of the yellow pages and I didn't have any reference of him, so he rather don't get the job than I get disappointed when it was too late. I simply told him that I was on a dead road, so if he was making his living out of photography it was enough for me. The pictures turned out well, but who knows if the woman would have had taken better shots? Nobody knows and actually I don't care much, I just wanted to have some pictures of the ceremony for when my son grows old. I have the ceremony in my brain camera.


Long story short Tom. If you were early before the wedding that's something the bride doesn't know and doesn't really care. If you couldn't meet the deadline due to personal reasons it's something that a customer really don't care about though can understand when explained. Maybe she got nervous and/or impatient because of the delay. You know that weddings are, specially for women, the BIG day for them. They diet, buy an expensive dress, get an expensive hairdress, make-up, in short everything must be perfect that day, and the pictures are the proof of that.


There has always been hard-to-deal-with customers, but 99% can be succesufully dealt of with a little politeness and a couple of big smiles. That's what I asked you, if you think there could have been a way to avoid the trial in such a way that both parties end up without feeling to have had given up in their money, rights or self steem.


Good luck in court. In my opinion, the best way to win a lawsuit is not to have one. This doesn't mean I will accept any kind of threat or insult in order to avoid a lawsuit, but if it's no big deal I rather reach an agreement, learn the lesson and get on with my life.

The only way to avoid their hate (this client) was to give them the photos free. (not about to do that)

Usually I meet the bride at the door when she is coming in before the wedding (which I did this time). So she does notice that I am early (which I did on this one and every one before this). I am all set up at least 1 hour before the bride shows up. As for the groom (like he really cares) I just let it fly loose. Most of them want me to go away. The whole wedding pictures thing is the brides idea and they could care less. Most of the time the groom would rather trade 1 beer per one picture.

I think I take thier wedding (future divorce) more serious than they do.

If I gave the groom a beer instead of taking a picture he would be game.

At this point I almost want my pics back, and have a bon fire for them and give them back thier money (now there is the elchaepo people know).. ;D Maybe make a video of it.... ;D

If they get nasty, there is always the delete button.  ;D I guess the morale of the story is "Pay for what you get, or you get nothing"  ;D

Finally got the papers today stupid (you know what) is sueing for $3,500! She is lucky I am as nice as I am ( I know my lawyer is not). Because at this point I say I want my proofs back, and she will never see the reprint disc. Then I can have a fire and give her back her money. I will wait to talk to my lawyer in the morning before I say "They will never get the images" for good. It is now a matter of copyright. I do not really care what the judge says about me having to give any images without recieving payment. If this happen I will simply delete them and they can crawl in a hole.

Damn it I am pissed.  >:(

I figure we can get the stupid crap dismissed and she can bring very expensive copyright attourney into Supreme Court. I do plan to counter sue. Will let you know how this goes.

Root for her fink you will be on the loosing side just like her. Now please stay off my posts, I do not follow you, I have better things to do.

Cheapo, are you sure you have copyright for pictures you took at THEIR wedding, that was a private event? In Spain you can take as many pictures as you want in the streets, but inside private properties the image rights are preserved. As long as the photographer is in the public streets he can shoot what he wants, even when the target is in private properties.

Seriously, your lose-lose strategy is the worst thing you can do. You have to maximize your outcome, even when it means somebody you don't like also does. Your strategy should be oriented on how much you will win/you won't lose, and not on somebody else will lose/won't win.

Here in the states, if you take the picture you own it. No exceptions.

I suppose you are right Raul. I just want them to pay for what they agreed to buy. I would also like to see them pay to have my door repaired. I want to deliver the images and never want to see them again. This may be the only wedding to date that we have done that will not be archived for later retrieval.

I just got back from my attourney. No he did not give me some "They have no chance" reply, he can't because he does not have the entire case in front of him, just the documents I provided. Anyway he said calm down, write a "written response" and counter for the remaining money and the damages to the door. And to keep my head about me as legal fees in small claims is limited to $100 so this stupid thing would cost me more to fight it with his help than it is worth at this point. However if it does go to trial then I will use him anyway.

I know what I said, but I always have a back up cd of all of the images I take. I will maintain copyright on all of my images and the deal will close like it was supposed to in the first place.

Only lessons learned here is that:
1. Stupid people will steal from you when possible.
2. Never make any promise of service you can not meet.

This I know.... I dont want to belittle her I just want my money due and to get her the pictures they paid for, nothing extra outside of fixing my poor door.

BTW, myy attourney found it interesting that his name did not show on the papers, only hers  ;). Really I wish them well, I just want my money without extra bs. ;D
