Abuse of power by National Park Service police

By DOUG THOMPSON

The last place you expect to run into a federal government goon squad
is the Blue Ridge Parkway, the scenic highway that runs through
Virginia, North Carolina and Tennessee.

But the abuse of power spawned by the Bush administration and the
rights robbing USA Patriot Act runs rampant throughout the federal
bureaucracy, as I learned this week while traveling the Parkway to
get to an assignment photographing a summer music festival for my
newspaper.

The festival, FloydFest, draws thousands of people each July to a
picturesque patch of land just off the Parkway not far from the Blue
Ridge hamlet of Floyd, VA. Now in its sixth year, the festival enjoys
a national reputation. It also provides an opportunity for the
National Park Service police to harass patrons of the festival.

For the last two years, the Park Service has brought in its "CIT"
(Criminal Interdiction Team) from Asheville, North Carolina, to
police crowds that use the Parkway to reach the festival. The team,
composed of swaggering young officers with little regard for due
process or civil rights, is the embodiment of federal excess.

As I drove towards the site Thursday, I passed two CIT Park Police
officers that had pulled cars over and were forcing the occupants to
pull everything out of the car so they could search coolers, back
packs, luggage, glove boxes and consoles.

I pulled off the road ahead of the second NPS patrol car, grabbed my
camera and headed back to take a photo of the police action. As I
approached, the Park Service officer wheeled around and pointed at me.

"Sir, if you raise that camera to take a photograph I will place you
under arrest," he barked.

I identified myself as a working journalist on assignment and said I
was simply covering a news event.

"Sir," he retorted, "this is U.S. government property and under the
provisions of the USA Patriot Act you cannot take photographs of
official government activity without authorization. Put your camera
down now!"

I could not believe what I was hearing. I grew up in this part of the
country and have photographed on the Blue Ridge Parkway since my days
as a high school student. I asked for his badge number. He refused to
reveal it.

"Sir, you have 15 seconds to leave or you are under arrest." He had
his hand on his gun so I left. Media General, our newspaper's owner,
has strict rules about interaction with police. At the top of the
hill, I stopped and shot some photos back towards the scene.

At the festival, patrons told numerous horror stories about
encounters that day with the Park Service Police. One young woman was
pulled over because she had beads hanging from her rear view mirror.
They detained her for more than an hour while they searched her car
and found nothing. Another young man was stopped because he had a
bolt missing from his license plate frame. When the cops found no
drugs or alcohol, they ticketed him for "improper equipment."

On Wednesday night, the CIT team pulled over a car driven by Shannon
Zeman, the sheriff of Floyd County, VA. Zeman later told a Virginia
State Trooper that the parkway cops were rude and abusive, even to a
fellow cop.

Calls to the Park Service police headquarters were not returned
Friday. According to the National Park Service web site, park police
"provides highly trained and professional police officers to prevent
and detect criminal activity, conduct investigations, apprehend
individuals suspected of committing offenses against Federal, State
and local laws."

Nice to know the park service cops have professionals on board. Next
time, let's hope they send the pros instead of the goon squad from
the Criminal Interdiction Team in Asheville.

I think thats more a case of A$$hole cops misusing power, than actual evidence of "the patriot act".  It almost seems as if he were blaming Bush for the rudeness of a few officers, not altogether under his control

Sounds like they're padding a resume.  Where I live (Washington D.C. area, inside the beltway) the Park Police separate themselves from "state and local laws".  My favorite road(inside the beltway) is the G.W. Parkway, and is policed by them.

I'm a proponent of carrying a copy of the constitution in your back pocket.  Make sure that when you get pulled over you have it on the dash.  If a cop asks you if they can search your car you politely say, "I'd like to decline your request, sir / madam as I have done nothing to give you probably cause to search my vehicle."  You are almost always going to get some real harsh stares but, in most cases, you'll be allowed to move along without having your rights violated.  In the case that a cop dismisses your request you should ALWAYS prosecute.  The bastards that take the job as a liscense to do as they please need to be eliminated in the most harsh way legally possible, and sometimes it should go further but I would never support vigelanty actions ::)

Of course, being a Libertarian sort of guy, I think the state should have very limited laws to try and enforce which is not the case today.

I'd like to add that a$$hole cops are not the majority, contrary to many people's beliefs. Sometimes, like in some small towns, they are. But overall most are in their jobs for the right reasons.

Whatever you do don't bring a view camera on a tripod
onto the D.C. Mall.
3 or 4 different police jurisdictions collide at that point
and the results can be awkward.

Constitution? What constitution. The Patrot Act is one false action to errode our rights. And take care if another strike happens on US soil. National Marshal Law will be enacted and there will be no more elections until a yet disclosed date. The New York Times has been working on the article about the secret document the Bush administration drafted years ago for marshal law.

You know guys, I am hoping our country either impeaches bush and cheney and removes these bogus laws, or that our country can survive another 1.5 years of this madness without some conveniently placed "terror" attack.

Patriot act breeds absolute power trips. The fact of the matter is the Patriot Act is unconsitutional and should be
ended by what ever means is necessary. I'd like to see Citizens really pissed off by this. That's my take Richard.

I majored in Criminal Justice at NCSU and was all set to work in law enforcement.
However there was a freeze on the NC SBI hiring at the time so I never did.
I did do my internship however, and noticed without fail that those who generally seek
law enforcement jobs are either lazy or on a powertrip.

Now it's been said in this thread already that most LE's are not power-trippers.
Maybe true, but for those who are,  the gang that their a member off (LE Gang)
will back them with "he's a brother" bull #$%*. The offending officer then
gets away with his usurpation of the constitution etc..........
Shannon's response was that since he was in Law Enforcement, he's our county sheriff,
he's was surprised at his treatment. I'm glad they ticked him off, since now he's seen it
for what it really is. (Also, points out he was expecting his Gang, since he's an LE, to show
him some respect, they didn't). Yea, I'll try to see Shannon and offer the view that
perhaps our county should reject all federal assistance in the LE area, plus, evoke the
High Sheriff code on which our country is based. That is nothing flies in our county unless
approved by the High Sheriff, the feds must ask permission to operate here.

Time was in this county that Park Rangers were run off by armed landowners.
I know of one older gentleman who did just that when the Park Service tried to
close one of his roads which accessed the Parkway. It's time for a return to the old standards.

Very sorry to hear this.  VERY sorry.

The NPS law enforcement guys out here are gems.  They volunteer with our local ambulance squad, and participate in trainings.  If anything happens in their area of operations, they show up to provide law enforcement support (traffic control, etc.), help the EMS and fire crews, and basically whatever they legitimately can.  They work well with the regular PD out here, too (State Police and county sheriff).

Well Medic.......unfortunately.....this whole country isn't on the same page. I can tell you from experience that if you get far enough into the "backwoods" in certain parts of this great country................common laws are out the window!!!!!! It sucks ass and it ain't right but thats the way it is.

I made the realization the other day that I had never read Orwell's 1984.  Funny I never did, because I remember reading Animal Farm and Fahrenheit 451 for high school english classes.  So now I've got it on tape and I'm listening to it in the car.

All's I can say is, Wow.  For a book that was written almost 60 years ago, it's incredibly up-to-date.  A frightening number of things that I'm reading about in 1984 seem like they're taken straight from today's headlines...  Now I'm just wondering when the Thought Police (NSA wire tapping, anyone?) are going to show up at my door to arrest me indefinitely.

Scary #$%*, man.

Seems to me that Bush didnt just magicallympass this bill by himself, didnt it have to pass through the Senate and Congress first?

I agree some of the wording is extremely suspect, even bordering unconstitutional, however blaming everything that goes wrong in this counrty on Bush seems kind of stupid.

I have heard good things about Ron Paul, No one seems to think he can win though

I read a bit about the author tonight, it seems that Doug Thompson's rants are well known within the media, and given zero credibility.

Said one writer, " Thompson frequently apologizes for, corrects, or simply disappears stories he presents at CHB as facts, usually blaming co-workers or untraceable sources."

Does anyone know the name of the CHB editor that Thompson fired for writing that unauthorised piece on Ron Paul? Hmmnnn, what's that smell.........? ;D

Ron Paul is constantly being denied exposure by the media so if he gets no where, thats why. He is all over the internet though.

Richard, bush has signed so many presidential orders and that is how he did it. He has signed more than any other pres in history.

Hell, Bush's first veto of a bill happened in 2006.  It's his job to balance out Congress. 

5 years without a single disagreement with Congress?  If he signed off on everything they put on his desk he obviously wasn't doing his job very well.

A presidential order does not go through congress. He signs it into law on his own basically.

When I first saw the title of this thread, I thought it was about the loss of the boob thread.

The media doesn't ignore Ron Paul for political reasons, the media ignores Ron Paul because no one cares about Ron Paul.  Most people will claim to adhere to a Libertarian ideology until they are challanged on specifics - e.g. Would you eliminate space exploration?  Farm programs?  The FDA?  College loans?  At that point people begin to sound like republacrats.

In defense of G.W.B., what would you do in his position of resposibility?  Had the WTC fallen on my watch, I would push the law as far as I could to prevent it from happening again.  No, that doesn't mean hiring thugs for the park service, but it does mean spying on anyone who might be rumored to have a cousin living in the same apartment building as a man with a connection to Al Qaeda.
