7 years of loyal service and not even a kiss
« on: August 19, 2007, 09:12:59 PM »
Long story short, I get to take the fall for a $53 000 engine that grenaded.  I was the supervisor during the shift that last repaired the engine.  I had seven years of service and had no intentions of leaving.  I just bought a house, have not even moved in.  I was called into the company presidents office where one of the "higher ups" began yelling and swearing at me.  I told him he was out of line, he told me I was fired.  I was handed a letter full of exaggerated truths, manipulated words and events that were strung together into one to make me appear incompetent.  The letter ends by saying I am terminated without notice or severance.  Seven years and not even a kiss after they F*cked me.  I am now out of work, take possession of my house next week, and looking for a job.  Sorry but I just have to vent.

Wow that sucks....

Keep in mind that you have options

I dunno that I would take a termination like that sitting down.

Get a lawyer and if you don't want to do that google employment law canada and see what pops up. You have been done wrong, as they say in the movies. Good luck.

Situations like this make other people, meaning the ones who havent seen the darker lining of the cloud, stand back and scratch their heads when people loose their last nerve and start stackin bloodied bodies... Just my cheerful opinion  >:(

They need to prove that it was YOUR lack of attention or skill that caused the engine to grenade.
Sounds like a big company. Need to get a lawyer and get some experts on that engine to determine cause of failure before the evidence is 'fixed'.
What kind of engine, and what kind of grenading did it do?
No.

you might want to look at this...dismissal with cause vs. dismissal w/o cause...

http://www.wiselaw.net/employment2.html#with

in canada, an employer can fire a nonunion employee at any time, but they must give you reasonable notice of the termination (or severance pay in lieu of notice) unless they can prove 'just cause', which is pretty difficult.

the last sentence reads....'In short, it is difficult to establish just cause for termination in a court proceeding, unless written warnings have been provided and adequate opportunity for improvement has been provided.  In most cases, reasonable notice is required'

i'd suggest seeing a lawyer.  good luck.

I dunno Canuck, you shouldn't let them get away with that. It doesn't cost anything to just talk to a lawyer and hopefully, he would tell you that you either have a case or you're wasting time and money. Sometimes, just a letter from a lawyer might scare them.

Canuck,  I second Needswork on this one.  At least talk to a lawyer, you should at least be entitled to some severance, probably more.

Good Luck.

Canuck how close are you to Ottawa, my wife had roughly the same thing happen to her and after talking to one of my daughters, who pushed her to, she contacted a lawyer that specialized in labour law mainly wrongful dismissals, who took on the case and won her a decent settlement. The company lawyers figured that who could she come up in a small town
that would give them a hard time and refused to talk to her, them they got this letter from the guy in Ottawa and researched his name and his cases and all of a sudden, then they started talking and making conciliatory noises. I think a case of oops, your dog may just be nastier than my dog. The settlement was then handled out of court. Sorry I can't come up with his name off the top of my head, if you want I'll ask.

Bill.

I just finished a similar ordeal, congrats.
At least your boss had the cajones to give you his BS reasons to your face, I got fired via email and didn't here my x employers trumped up reasons until a month later when we had a hearing. Luckily an employer needs proof for this type of dismissal and neither of ours had any.

Good on you. You should never have been put through this BS.
Did you find a new job in the meantime?

The biggest trumped up BS reason was the $53 000.00 I supposedly cost them. The labour board asked for reciepts, they only had $5000. Turns out Volvo covered the engine

Glad to hear your with better people now.
The statement above makes me wanna go postal!

Interestingly, after all the carnage, they don’t say, “he went mechanic”.

Maybe they should.
