I have lurked and not chimed in for some time.  Just want to congratulate you, Bill, on what you have done for your Dad.  Good job.  We know it wasn't easy.

As for Alzheimers, my mother and aunt both dealt with it.  Long before placement in a nursing home was necessary they couldn't remember recent events, were losing the ability to read, write and handle math, didn't recognise familiar places or people but were crystal clear on things that took place thirty years ago.  From what you have told us it doesn't sound like your dad is dealing with any kind of dementia at the moment, or if so, it is very mild.

May you and your dad enjoy his remaining time together reliving the old times and finding happiness in the new ones.

And, though you may not be ready for this right now, a prayer that your brother will come to his senses, reform himself and be reconciled to your dad and you.

      You know, there's the saying that, "There's ALWAYS Hope". Well, for about 20yrs, I had that feeling that ONE DAY my brother would wake up and realize that there were only 2 of us and would (at least) meet me half-way. But that day has never come. In fact, on that day in June 2007, I thought (as I drove to Little Rock, because Dad was in the hospital with pneumonia) that this was going to be a time that we could come together for my Dad AND ourselves and be a family again. Instead, I found out how, once again he was trying to stick it to me once again AND how he was attempting to get total control of my Dad, put him away and take everything for himself. I'm sorry, but enough is enough. I don't even remember how many times I've given up on him and then made yet another effort, only to be put down once again. I'm so tired of getting back up. He can be the one to make some efforts to reunite us. That would work, but he won't do it because he thinks he deserves everything and doesn't want to be bothered with taking care of my Dad. He has more important things to do, like Fishing, messing with his old GMC Sprint (basically a Chev. El Camino, for those who don't know) and whatever else he wants to do. Think about it, the 2 of them took over my Dad's life and affairs, pushed me completely out of everything (that my Dad had set up and wanted me to be in charge of) dropped him off in a Nursing Home LONG TERM And "Went Fishing!" He is 51yrs old and I'm 61 (62 in March) Dad is 83. We're not getting any younger. The 2 of them have disrupted my Dad's life for going on 3yrs now and ours for 2yrs. Like I have said, "Enough is Enough". If there is to be any peace in my Dad's life, David and Jan can not be there. If only you all could see the difference that I have seen in the way my Dad slept then and  sleeps now. He used to be so restless, talk in his sleep and now, he sleeps so peacefully. :) Total difference. Please understand that I am in no way coming down in anyone, it's just that I am so frustrated about the way my Dad has been treated and neglected.

        BTW, Denney's is giving away free Gran Slams and we're going today (he doesn't know it yet) ;)

   Thank you Chris, Dad and I went over there about 10:30 (since it started about 6AM, I thought that maybe the crowd wouldn't be so large....WRONG!!!!) and so I suggested Western Sizzlin (Dad likes there too!) and he agreed (pretty quickly) and so we went there and had a "Jam Up Meal". I told him that I'd take him to Denney's in a few days, for that Grand Slam (and he's already ready for that too!! :D

    Glad to see you back too! ;)


      BTW FOLKS,  I got a letter from our Lawyer today and as soon as the the paperwork is finalized (from the Guardianship Lawsuit), he will be pushing those TWO to give up Dad's things. AND he included a copy of the actual document that the judge will sign and at the bottom, there is the statement that ends with these words:

                 "DISMISSED WITH PREJUDICE!" ;) 

            (so, she can't do it again AND he can't do it because of the "felony"!)

      The last thing I had gotten from the Lawyer was a copy of the "Unsigned" document showing that the case was "Dismissed With Prejudice" and the Judge hadn't done her thing on it yet, Well folks, Today (after returning home from being at our work place going through recertification) I went to the mailbox to find a thick envelope from the Lawyer and it was "The Official SIGNED Order of Dismissal" that had been filed and makes it TOTALLY Finished, as far as the Guardianship is concerned! 8) ;) Now, he is wanting to get with me and discuss the Filing of a "Replevin Complaint" (never heard of one of those) for my Dad's personal property! Although, we don't care what they call it, as long as my Dad gets his stuff back. Now this is where it might get sticky as far as what they might have because my Dad doesn't know everything that they might have and an example is the fact that he was saying that David had gotten a 38 Special that my Dad had and I know for a fact that my Dad had previously given an Uncle (on my Mom's side of the family)
the only 38 Special that I knew of him having and he suddenly is claiming that he had 2 of them. Dad and I had talked several times about anything that David had gotten , that had a serial number, was going to be hard to prove if you didn't have the serial numbers
of those things. I'm trying to help him understand that we will ALL that we possibly can. For sure, we should have no problem getting the Van, the Truck, the billfold and the cell phones and some misc things. At any rate, we should be on a downhill run on this. ;)

          It IS fantastic my man! And all my Dad talked about for a few days , was how the Lawyer AND the Judge went up one side of Her AND HIM (S & S) and put them through the wringer! Yeah, Dad really enjoyed that! :D ;D :P ;) Even though my Dad knew I was doing my best to take care of the things that he wanted me to, he hadn't really seem progress like he saw that day in the Court room, and he was duly impressed. Everything turned out just like I told him it would! ;) Now, he's putting out more effort to getting up and around with the walker more and he's got a better outlook. Only thing is, he's not as able as he thinks he is and I just am not sure how I'm going to handle him wanting to do things like drive again. So much more for me to try and make sure of what he can actually handle and all. But, I figure it's all a part of that I need to do and I will continue to do my best for him. ;)  After all, He IS my Dad! :)

        Thank you for the kind words, I'm just a simple person trying to do what's right AND make sure that my (who was greatly responsible for me being what I am, along with my Mom AND my Sister) Dad is mnot mistreated, cheated or abused. Of course there were other Family members who were involved in trying to teach me and all, but my immediate family was what I was centering on. :)

         I feel that we ALL (here) are a pretty decent family and it shows each and every time that any of us have a situation that shakes us up or concerns us and I'm really proid to be a part of that. 8) 

         BTW, yesterday, the Lawyer sent me a copy of the document that shows that the "Guardianship Lawsuit" has been "Dismissed With Prejudice" (she can't do it again and HE can't because he has a felony) and has been signed by the Judge and officially filed at the Court House (with a copy going to their lawyer! And also that he will is preparing to file (what is called) a "Replevin Complaint" for my Dad's Personal Property. ;)  IT AIN'T OVER YET!!!!!!!!! :P Dad was well pleased to see the actual Document that had been signed filed and delivered. ;)

       Several things going on. Here's a quick list:

               (Not necessarily in this order)
       1.  Get with the Lawyer about his pursuing "Getting My Dad's
            Stuff Back" I call it "Phase II" and we're REALLY looking
            forward to Phase III (the FINAL one)
           
       2.   Arrange a trip out to see okie to meet him and
             pick up some Super Hawk parts.

       3.   Arrange a trip down to North Little Rock to a cousin (we
            actually just call him "Cuz". ;) ) and pick up a very old 
            large vise that was part of the old "Shop" and bring it back
 
       4.   Arrange a trip to Memphis (when the time comes) to get to
             meet John (jtb) and get that Jawa 250 engine.

       5.   Arrange a trip to see another cousin (on my Dad's side of
             the family) The last time he was there was when he was
             taken by Jan and our cousin told me that Jan would
             interrupt the conversation each and every time that my
             Dad tried to say ANYTHING! Well, NOT THIS TIME!

       6.   (Hopefully) Arrange a trip to California late this
             Summer to see 2 more cousins tha my Dad hasn't seen in
             years. (Never know how much time is left for ANY of us!
         
          BTW, if I change the title of this to "Dad's Situation, Phase
                  II", don't be alarmed, it's just the next step. ;)

I thought that I was through going back to Kansas since I don't have anyone there anymore, but Martha says she wants to go back because she thinks it's pretty.  So, I told Okie I would call him when we go again and we could get together.  We should all try to get together for lunch or something one day when it happens.

          Yeah, I agree. My Dad needs some GOOD things to focus and that's what I'm trying to do, is give him GOOD things on which he can concentrate.

          He had kind of a bad evening yesterday though. :( Dad was at his apartment and we (my Wife, Daughter and the 2 Special Needs young men we work with, had just gotten home after taking care of some things in Fort Smith and I got a call from the Assisted Living where my Dad's apartment is. It seems that he was preparing to go to Supper, when h went to the bathroom and that was as far as he had gotten. One of the workers came to check on him and found him in the bathroom on the commode with him leaned over onto his walker seeming like he was going to throw up. Well, I had to get back up there ASAP and I found him still there in that position He had thrown up some and was really weak. With his okay, I helped him finish up in the bathroom, we got him some Pepto Bismo, then, I got him into the bedroom, helped him to laydown and get comfortable. I stayed there with him and after a short time, he said he WAS feeling better so I excused my self and quickly went to the grocery store and got some things like Sprite, Gatorade and crackers. When I got back, he was "sawing logs"! 8)
I stayed over for the night and I'm telling you that everytime he coughed, I was up and checking on him and didn't feel comfortable enough to go to sleep until about 2AM! Then at about 615AM, a worker comes by and announces that it's almost Breakfast time and get ready to come to the dinning room! That night's episode must have a one time deal because he sat up and was getting ready to go for Breakfast! :D It was almost as if the incident the night before, never happened. Now, while I WAS a bit skeptical about how he would feel this morning, I was really elated to see him getting right back into the routine of things so easily. 8) Things like that (the seemingly quick recovery) really help keep my morale up, I can tell you that!

          Oh, and  John, it's too late...............I'm already committed to take some of that Super Hawk JUNK off of his hands! ::) ;D

           That would be nice to us to get together, and if Dad and I are available, we'll see what we can do. ;)

           Man, I get that Jawa engine AND the stuff I'm getting from okie and I'll be a lot closer to being able to get that old Jawa going AND do some pretty good damage to the old Super Hawk and get some ideas about what I can do with the 67' CL77 "Roller" I've got as well. Ha! I might actually have some reasn to talk about MY motorcycles after a while. :)

           Looking forward to meeting you in Memphis (and I'm not trying to rush, I appreciate the efforts and offers involved by you all will (and those who would have helped too)! 8) ;) Mere words can not express my thanks!

          Oh yes, there WILL be updates. I'll do my best to keep everyone aware of the progress of the "Legal" side of this AND the humanitarian (only word I could think of, that sounded like it would be right) side as well! ;) I figure that with all of the Prayers, Well Wishes and Support that You All have put into this effort, you deserve to know the outcome AND progress as we get through each part of this.

         To be perfectly honest about it, I have heard of cases where an old person hangs on to living just long enough to see things set right.................and then, passes on. Now, I'm not expecting this (at least I'm not consciously expecting it) to happen like this, my Dad and I have lots of time (that S & S have cheated him out of) to make up for.

      Well, I got a call from the Lawyer and here's the plan:

        1. Defeat the "Guardianship Lawsuit" DONE

        2. Get my Dad's stuff back "In Process" _________

        3. Get them EVICTED!  "Final Objective" _________ 

   Makes me wonder if they actually think it's over and that we are   
   going to let things stay as they are? ???  Not Bloody Likely!" :P
 
     
    The Lawyer told me that, when on the stand, David said that they were having some problems with my Dad. So, out Lawyer asked, "What kind of problems?"  One thing that David replied was that they couldn't get him to keep the oxygen hose on him. Our Lawyer then asked if my Dad was in the room and David replied, "Yes he is" and then David was asked if he had the Oxygen hose on and David replied, "Yes he does" and David was then asked if he saw my Dad before the hearing and David replied, Yes I did and we talked for a while, to which the Lawyer said, did he ever take it off or seem uncomfortable with it? And David replied, "No he didn't" and the Lawyer threw in that it seems he hadn't seen my Dad since the 1st of August and it seems like he's made alot of progress that he wasn't even aware of and wouldn't you say that Mr. Van Pelt was doing pretty well by now? By now David was pretty flustered and the Lawyer ended up with, "Why didn't YOU pursue this of YOUR wife! David replied rather sheepishly that he couldn't because of his felony. :P 

       There's alot that my Dad doesn't remember about that day, but he knows that they were made to look just as foolish as they are and that gives him pleasure, since they have given him so much crap. And, when I told him the details that the Lawyer gave me, my Dad agrees and has a smile on his face when he thinks about the way things went for them! ;) 

       He's still doing well by the way and looking forward to each day! 8)

      Well, I went to see my Dad this morning, after a trip to Wal Mart to pick hum up some different kinds of juices and such (Orange juice, Grape Juice, Grapefruit juice and thought I'd throw in some Tomato juice as well). When I got to my Dad's apartment, I was told right off that he was still in bed, wasn't feeling good, hurt all over and felt like he'd been run through a saw mill. So, I went in to check him out. He was really feeling bad and I was concerned that he might have gotten the flu. I called my wife and had her call the Doctor to see about getting him in to see him and I went about mixing him up some juices in small bottles and adding "thickener" so the juice would go on down his throat and NOT into his lungs. My wife called back and we had a 10:30am appointment. Helped him dress and got him to the Doctor's by 10:15am, got him looked over real well, they did bloodwork, urine sample and complete chest x-rays and he was really pooped by the time THAT was over. His white blood count was up some and he got some antibiotics, along with 2 inhalers (a medicated and one to help with clearing his lungs as he needs it). While we were out, I took him by Denney's before going back to the apartment. I had to go take care of some things, after I made sure that he was settled in. And I went back later this afternoon and he seemed to be doing well. Hopefully, he'll be good for the night and tomorrow (I'm heading down to the his place tomorrow morning to attempt to get his safe open so I can be sure of just what's in there, as I am in the process of putting together a list of things for the Lawyer to go after. And, after he gets that chore taken care of, he's going for "The Throat!"....Uh, I mean.......

       Well, this day has not been good. It started out with me stopping by my Dad's apartment this morning, on my to his place, and finfing him partially dressed and no energy. I Asked him if he wanted me to help him and said that maybe I needed to stick around. He wouldn't have it though, said he was just a little tired and he'd rest a bit and take care of it. Well, with that being said, I left and headed to the lake to try to take care of some things there. I could not get that stinkin' safe open, the water system had been contaminated and I ended up cleaning the both camodes and bathroom sinks because of the dirty water and by that time (I had already tried that safe about 6 or 8 times) my Wife called me and said that I needed to come back because my Dad was on his way to the hospital because of complications which ended up being because of low blood sugar! So, I sail back to Fort Smith (2hr drive)
to find him in the Emergency Room and not knowing why he was there and such. Now, we find out that his kidney's aren't functioning well enough to dissolve his pills that he takes for diabetis and when the pills Do get completely, the blood sugar level drops, causing him problems. So, they are going to change to insulin once a day  and hopefully he'll be coming back to his apartment in a couple of days.

        I was hoping to take him and go to okie's sometime next week to pick up some Super Hawk stuff, but I'm not sure when now. :(
