Haha!  Bill when I first saw the updated thread title, I said to myself, "Wait, is "dismissed" good or bad?!"

I furiously searched for the good news, and when I found it I must say a big smile came across my face and I said, to myself, "Awesome."

Good for you!  That's REALLY awesome!  ;D

Thank you guys, we really appreciate it! I'm still trying to take it all in and wondering if it is really over (as far as the Guardianship goes). I'll be COMPLETELY relaxed when it is ALL over. ;)

                          Thanks Guys, Bill ;)

Me, too!   And even then, when I read Bill's first words, it was just the one line:  Dismissed!  And I was like, well, wait a minute, I STILL don't know if dismissed is bad or good!  I guess I didn't fully understand what the whole deal even was.  My bad.

Anyway, congratulations Bill!!

Thank you Kirk, appreciate that!  ;)

Dan & Kirk, when I got back, I just had a few moments and had some things to take care of and wanted o let you all know SOMETHING, so I just simply posted DISMISSED with the thought that, since THEY brought the Lawsuit on, to be dismissed was to kill their efforts. I thought that the message would be understood, Sorry bout that. :-\

I echo Terry's and Greg's sentiments.

Sad it came to this; but you are the clear hero for standing up and staying the course for the long haul for your Dad's sake.  It took courage as well as clarity to realize that you can't give in, even though it meant going head-on with family.

You did good, and you did well.  We're all proud and blessed to be your friends.

To sleep perchance to dream. Sleep well my friend.

Thank you, I actually slept pretty well last night. Gonna see if I can get a transcript of that hearing cause I'm just aching to check it out. Between what my Dad can remember (which isn't much, I'm afraid)
and what the Lawyer told me, I'm really wishing I could have heard it firsthand! ;D

Thank you Mordechai, I really appreciate your input here and compliments also. I definitely had a "Guiding Hand", alot of Prayers and Support from You All, My Family, My Church and Lots of other folks (to include a number of folks that I came into contact with during all this (Dad's Bank, the County Clerks' office in at least 3 counties in Arkansas, DMV in Perry County, Lady in the Post Office, the Nursing Home in Perryville, the one in Greenwood, the Hospital in Morrilton, a fellow at Alltel, my Dad's Church and numerous others).

Dad DID say that they gave her a pretty good going over though and once, she started to get up AND the Judge told her to sit back down! :D ::) :D  Dad also said that our Lawyer had some info on some criminal background of her's and I told him, "I know, Brenda (my wife) took it upon herself (with our money) and hired an investigator, found out about the "Hot Checks" and I went to the Washington County Court House, got that info and faxed it directly to our Lawyer." :D ;D :D ;D  Dad also said that she was given the 3rd degree by the Lawyer AND the Judge!

And our Lawyer, besides whatever else he put to her, he asked her if she had read the statement (about the Alzheimer's) that a Doctor furnished her and she said, "Yes, she DID read it." ANd he asked her if she read ALL of it and, once again, she said, "Yes, she read the whole thing!" So, he then asked her if she saw the sentence on the back where the Doctor said that, Mr. Van Pelt needs the assistance of TRUSTED caregiver! And she said "Yes" to which our Lawyer said, "Isn't it true that you and Mr. Van Pelt Are Not on very good terms? ;D To which she (ACTUALLY, TRUTHFULLY) said "NO!" ;D ;D ;D ;D ;D He didn't have to pursue THAT point any further. ;)  Our Lawyer also told me that that Judge (female) could spot BS right off and she come down on HER (Jan) like a Ton Of Bricks!! ;D :D :D ;D ;D :D I tell you, I am all beside myself, I just HAVE to see that transcript! They also had a field day with that check she wrote off of my Dad's checking account for $7,000. She claimed it was a loan! ::) She said that $6,000 was to pay off David's bassboat! He bought that sucker back around the late 1990's and I would have thought that it would have been paid off before 2007. :P Anyway, then the Judge wanted to know about paying it back and she said that she made a $200 payment in Aug 2007 and another payment of $100 in Sept. Then the Judge said, "What about Oct, she said "No" and what about Nov and she said "No". Then the judge said, so you made no more payments and she said , "No". So then, the Judge wanted to know where the boat was and she replied "David has it!"

Now, the Lawyer is working up a last request for my Dad's things, setting a specific deadline and, if that's not met, we're going back to court! I'd love to see this come before that same Judge! ;)

                                     Later on, Bill ;)

You got it, but it ALSO made me wish I could have seen it happen! 8) ;) My Dad DID see it though and was quite pleased! Siad he almost laughed out loud during part of it! :D I'd been telling him that with all that I had furnished the Lawyer with AND what ever he had come up with AND the way he put it together with the Legal stuff and all, we SHOULD be A-Okay! & We were! I reminded my Da that they said that they would take care of him and they put him in a nursing Home LONG TERM! Then < I had told him that I'd take care of him and I've done so while telling everything that was going on, as I did it and followed through with info that should get them off his case! ;)

Wow, great job Bill. I've been reading this thread (in all it's names) little by little, trying to catch up. Just a week ago (to me), you were struggling with your Dad getting mad at you and being in a temporary residence.

Bravo!! You are a good son and your wife is a good daughter in law. Your Dad must have done right in life to have family like you two. As for the other brother, I have one myself that is a real PITA. I can't be near him and moved the whole way from PA to OR to give myself some space, along with other reasons. I hope you guys don't have to deal with any more of their sh!t from here on out. You deserve a break. I can't wait to see some pics of the Jawa when you get going on it.

Congrats!!!  8) 8) ;D

Thanks for that Mickey! 8) We are just trying to do "the right thing" by him! And, like I've told him all along, "I'm just trying to give him more peace of mind AND the ability to relax and get some peaceful rest! Yeah, hopefully, the MAIN part is over and we can now get his things back AND get them out of a House that my Dad is paying for! Both our families were in the Little Rock area and WE move up to the Fort Smith area when I accepted a Civil Service job at Fort Chaffee back in Dec of 1972 (about 150miles away). If it weren't for my Mom and Dad's place down there about 45miles West of Little Rock (with Dad wanting to "Go Back Home and ME wanting to keep that place and spend some time there myself) I'd see about selling it myself, but I don't want to sell ir either.

Soon as I (we) can get started on that Jawa AND I can get to where I can post pictures again, I'll be putting them on here. ;)

Been doing some thinking (yeah, I know that that is Hazardous! ::) But, anyway I'm thinking that since they (S & S) had such a hard time Friday, on the stand, maybe we won't have to go through that again. I mean David CAN'T because of his FELONY and Jan, according to my Dad AND the Lawyer, was really "raked over coals", so maybe she has finally gotten the idea that it ain't gonna happen! As long as I'm able to, I'll be there to stop them at every turn! :P Also, I think that even though my Dad trusts me and all, he was always adding that he just wants to go home and get his life back, but since the "Day In Court", he has been more receptive to realizing that these things take time and he seems to be content now to let me get everything taken care of before we go back to his Home at the lake. 8) For some time, I was having to remind him about the steps that needed to be taken before we could go there comfortably and now he has eased up on me about that. I would prefer that he stay up here and make occasional trips down and stay for a week or 2 and then come back up here, but I'll do whatever I need to do. :)

I don't want to be the one who urinates in Wheaties, but what about getting your Dads stuff back and evicting them?  And at one time, you had mentioned a rowboat that was at your Dads place that belonged to a friend of his, and the possibility of S( of the infamous S & S) having taken it.  Did you ever confirm it's whereabouts?

Well, I thought I'd mentioned that the Lawyer was already on that (getting his things back), is sending them a last request for the stuff, giving them a Deadline and will pursue it in Court, if needed! ;) He'll also be doing an eviction notice, to get them out of that house and I'll be checking into seeing about (legally) keeping them away from him (And from me)! As far as the fishing boat goes, the owner's Son has it. Sorry if I left some of the details out, I was so happy that they (S & S) got took care of by the Lawyer AND the Judge! ;)

Bill Sorry I didn't chime in sooner. I had wanted to congratulate you sooner but wasn't able to get on an actual computer. I was able to log in via my phone on Saturday to see the great news and put my mind at ease. Unfortunately I spent the entire weekend helping my Brother in law and sister in law move and only took enough time off to do my other job (DJ'ing a wedding) on Saturday.

Anyways, I am so happy for you and especially for your dad!!

Well at the very least this particular chapter is closed.

Another tough choice coming up;  now that Paul Newman is gone, who is going to play you in the movie?

Seriously, though- Having dealt with several Alzheimers parents already, let me suggest if you take your pop to the lake, you better check on him (and his refridgerator) every 4 or 5 days.  You might well be surprised at what does and doesn't go on there while he's left to his own devices.

Don't even worry about it Dennis. I knew that you and the others would be happy for us being able to shut them down. ;) This has given my Dad a boost and reminded him that everything I have told him, has happened and he isn't pushing as hard to go directly to the lake like he was. Oh, he still wants to go but he's realizing that we are working toward that goal AND he will get there (if at all possible). I trust that the moving AND DJ'ing the wedding went well. :)

I have NO doubt about the support from you all and am proud of it! 8)

Thank you firecracker, it sure feels good too and my Dad keeps talking about how they (the Lawyer and the Judge) went up one side of her and down the other! ;D I think the events of the Guardianship hearing n Friday, is sinking in better now. Friday at the Court House was something else. First, I like to never have found a place to park where I could get my Dad out of the van and into the Court House. Then, had to go through the security screening (taking everything out of the pockets, and I just happened to have alot of change ::) ) And then get my Dad to the 3rd floor so we could meet up with the Lawyer. Then I had to go move the van because that was a "Wheelchair Unloading place, Only" (I used it for my Dad and his walker). Then I finally got a parking spot about 2 blks from the Court House, after someone else pulled out. I put the parking meter to the max, which was 4hrs! Went in, was introduced to THEIR Lawyer (who was wishing that he'd NEVER EVEN SEEN them! Then THEY showed up! >:( Then, they had the nerve to want to see him. ::) Now, I am aware that both of the Lawyers thought that, if they could see how well he was doing, that they might just drop the thing. ::) I could have told them that that was just "Wishful Thinking". It would have been good, but I knew that it wasn't going to happen because they are just too GREEDY & STUPID!!!!!!! Plain And Simple! Then, I had to sit outside the Court Room in the same area where David was and time just seemed to DRAG!! Then, they went first and went through the proceedings and when it came to OUR turn, Our Lawyer stood up, quoted some Law (don't remember which one he said it was) and asked that, the case be dismissed! Then judge said that she was mindful of that law, thanked our Lawyer for bringing it up and said that she agreed with him and dismissed the case! Then they opened the doors and asked us to come into the CourtRoom and I wasn't sure why, I thought maybe there was a recess or something and our Lawyer looked at me and indicated that it was OVER! 8) ;) I looked at my Dad and he was grinning! It didn't really sink in right away. Oh, I knew it was over but it was like I was waiting for the other shoe to drop or something. Gotta get a transcript so I can read about all that went on. ;D

Now, the Lawyer goes after my Dad's things and rounds it off with "The Eviction Notice"!  Updates AND details, when they are available! ;)

Thanks again to all for the support in this,   Bill ;)

Another tough choice coming up;  now that Paul Newman is gone, who is going to play you in the movie?

Seriously, though- Having dealt with several Alzheimers parents already, let me suggest if you take your pop to the lake, you better check on him (and his refridgerator) every 4 or 5 days.  You might well be surprised at what does and doesn't go on there while he's left to his own devices.

Hey Uncle.     Paul Newman, huh? ::) Hmmm, is there a likeness? :D Ha! Ha! Probably more like Chevy Chase. ::)

I hear what you are saying Uncle, but there has only been ONE Doctor who has said that my Dad has Alzheimer's and HE would not comment to me about how he drew that conclusion! Everyone I have talked to and everyone who has seen him and talked with him have said that he doesn't have it. One main thing is that he is more alert, knows who he is, knows who other people are, and can concentrate on things well enough to: Read the newspaper, Do "Word Searches", play games such as Solitaire on a handheld game or on his computer. In the beginning  of getting things roght, I was taking him to a family Doctor for an appointment (I had never been to where this Doctor is) and I was looking for the street where the office is and my Dad said, "You just passed it". It didn't even look like the area where it should have been (looked like a housing area). Bit, I turned around, turned up that street and almost passed it up, when my Dad said,"It's right there!" I looked and sure enough, it was! I was beginning to think I was the one with Alzheimer's!   ::)
