Someone is trying to sue me?
« on: March 15, 2008, 03:55:35 PM »
Canadian legal question. Someone is aggressively looking for me, starting today and I believe they are trying to serve me. They have been coming around to my old address (my parents) and keep calling looking for me. All they will tell my parents is that it regards an accident I was in two years ago. Long story short, I was not at fault as ruled by the JP. Is there any way to find out if someone is trying to sue me without actually getting served? I am covered for this anyway by my insurance so I'm not concerned aboug that, mostly just the aggrivation.

While in the US I might try to call the county clerk in the area where the accident occurred, or where the other party resides to see if there have been any cases filed that include you, I'm not sure what to do in Canada. All I can say is that sounds irritating and stressful, and good luck!

The woman behind the desk at the Local Municipal Court is not trying to serve you. You won't get served anything there.
The advice given above will work fine here in Canada as well.    Just go in and ask............

I once had a friend go into the local Police station to see if there was a wrrant out for my arrest.  There was, I then could make my decisions from that point on based on good intel.  Turned myself in a few days later with clean clothes and my tooth brush..................

Ended up beating the charge and I have not had a fight since ;D

Get more info and be on the offense not deffense

Search your name & town on a few search engines... just in case something pops up that might be a clue..

They may be trying to get you to testify re that old accident.

If you are being sued you may as well tell the guy where you are and take the papers. If you think about it logically doing all of the cloak and dagger finding out what it is about will not change the terms of the suit which you will have to defend. Here is advice given to me by a Lawyer friend who represented Insurance Companies. I had a server looking for me also at one time.

1. Call your Insurance Company and tell them you are about to be served.
2. Tell your parents to have the server call you and set it up with him a time to drop off the papers.
3. You will then turn the papers over to the Insurance Company to have one of their Lawyers answer the suit. Your Company may just settle with the guy and it is done, or you go to Court.

It is, what it is, and you can stop being a fugitive. Anybody can sue anybody for anything, that does not mean they will win.
