Because your torque arm is pointing downwards, doesn't it?

but I'm kind of slow this morning. Yes it does mount like this was the case although I'll have to go and check again.
Bryan, what I mean by the pedal sticking up is that the 'pedal shaft tab' (where the rod attaches to) is pointing almost vertically up too close to the swingarm. If the brake pedal is depressed, this tab will immediately hit the swingarm and stop turning.
rbmgf7, no I forgot to take pics of it and I don't have a scanner so drafting in a piece of paper was not an option. Didn't take more than 4 minutes as it' not up to scale.
