Today my wife had a gentlemen in her courtroom who was arrested for speeding and fleeing from the police.  He was initially spotted on his motorcycle at moving at a very high rate of speed.  The officer that spotted him was traveling in the other direction and radioed to another officer who then clocked him at 148MPH on a 45 MPH road.

Anyway, he plead not guilty and had his day in court.  He told my wife that his motorcycle would not go that fast - GSXR 1000.  My wife told him, "Sir, I beg to differ. I was just at a drag race on Friday with my husband who rode his 1972 Honda motorcycle 118 MPH in a 1/4 mile.  I am neither naive nor so dumb to believe that your modern superbike can not achieve the speed at which you were clock.  Let me remind you that you are under oath and before you purger yourself any further, you may wish to rethink your previous statement."  He then had the stones to say, "well, there must be something wrong with my speedometer 'cause I slowed down after I saw the cops."  My wife replied, "Okay, so based upon what you  have just said, you therefore must have been exceeding the 148 MPH at which you were clocked before you slowed down."  Dumb look on his face.  "Ummm.... no I slowed down, ummm... I wasn't going.... I didn't try to run from the cops.  By the time they caught up to me I was way ahead of them.  I didn't think they were chasing me."

You should hear some of the stories she gets.  Like "I didn't see the flashing lights because my windows are tinted too dark" or " I didn't hear the siren because I had my iPod on" or "I needed to get home fast because I realized that I locked myself out of the house"  huh??? or one of the best, "yes I was speeding but only because I was running out of gas and had to get to the gas station fast to fill up!"  duhhhhh!

Well, you do get better gas milage at higher rates of speed. ;D

But I do know this..

 I cant ever tell Sparty the story of the local guy that clocked 175mph  :o at bonneville on his pretty stock ZX10... no Siree.. not gonna tell that one...

Actually that road where he hit 140+ is long and straight and very easy to hit triple digits.  It is a four lane bypass road that cuts through town to help elevate traffic congestion through town.  Safely hitting 140+ is no problem other than it is 100 MPH over the speed limit.  If that clown didn't try to run from the police, they would have most likely cut his fine to a 80 MPH ticket and he would have been able to keep his license.

Personally, I wish you and her would come here and be one of OUR judges...we could use some common sense (and another fast K2!) in CO.

Was there a financial penalty imposed, Art? If so, do you know how much?

I received a ticket this summer and went to court after the officer who issued the summons encouraged me to do so. Although I too was a complete babbling fool during the hearing, my fine was reduced from $300. to $100.

I thought perhaps that the cost of the jury trial which I was entitled to following the hearing was sufficiently expensive for the county that the magistrate I spoke with to offer me a financial incentive to settle. Otherwise who not just make me pay the $300. as they had me pretty much like a deer in the crosshairs?
