Being at the wrong place at the wrong time has never stood up in court...  Of course it wasn't intentional, but neither is accidentally hitting a pedestrian with your car or accidentally hitting someone in the head with a hammer you dropped off the roof.

Just because act was unintentional does not remove the perpetrator's personal responsibility.  At the very LEAST a wrongful death civil suit should be pursued.

do you remember that british? soccer game in the 80s where people were getting squished through the chain link fence?

we should throw all the people that were directly behind them in jail... i mean c'mon... they were the ones that were in direct contact w/ the deceased.








what really happened after that incident is they started pre-planning damage control... they didn't ban excitement or herds or rushing people.

point is... are you going to send the mob to jail?  or just the few who's feet actually trampled the guy?... a herd is chaotic and accidental in its movements therefore shouldn't be judged per individual.  but if the herd is accidental in its movements, then you must look at how those accidental movements were set in motion.

I remember the good old days when it was just the SOHC 750 site................ ::) ;D

Oh, and I agree with Heffy, most of the front guys were pushed over the top of that guy by those behind them, so they should all be charged, or not at all.

I like Hef's "take a ticket" idea too, that could have saved that guys life. Of course, if Walmart didn't have those stupid "Doorbuster" sales, it would never have happened, so they would also be liable to prosecution, for their lack of "duty of care" for their employee, for not planning a safer method of allowing the crowd into their store. (Automatic doors, perhaps?)

What about a couple of "crazy Mexicans" having a mock "gunfight" inside the Walmart foyer, just as the doors are being opened? That might slow the crowd down, somewhat? ;D

Not to trivialize this, but when I was about 14, I learned about sales and where not to go, we had a store in Vancouver (Woodwards) that would throw super specials on and the mob that would come through that door was ferocious, the employees would throw open the doors and stand aside while the herd went through and god help you if you were in the way, it was mostly little old ladies, grandmothers, but if you were in the way, it was cane on the toes, elbow in the ribs, kick in the back of the heel, point of the umbrella in the knee cap, I was at the time shocked and horrified, I didn't believe that grannies were that savage, 14 you know and like all 14 year olds a fool, I got caught twice, never again, so this is not a new thing, just carried forward too much and if it's been like this for a least 50 years + mart of the wall must have know of the possibility and should take some responsibility.

What I dont understand is this was at a walmart.... I thought walmart didnt have sales and only did "low prices" all the time. If anything does go on sale it just ends up being the price of that item after the sale regardless. Its the walmart motto. "Low Prices Everyday" I dont freakin understand how there was so many people rushing a walmart.... WALMART PEOPLE! Honestly........ Im going to go throw up.

There was a follow-up story in today's paper on this. It seems the poor guy was a temp employee and the article seemed to be make a big deal out of the fact that he had not had any "crowd control training." Give me a break!

This is not the first such incident during these 'holiday sales.' That being the case, Wal-Mart should have foreseen problems and I think some heavy legal lifting will be in order for them on this one.
We'll all be someone else's PO some day.

Has anyone actually LOOKED at the doors outside a Wal-Mart??

Every one I have seen has a double set of sliding doors with pull doors in the middle.

Sliders.... Now they broke those doors.

Ever pushed on a slider? Not slid it, but pushed it like a regular door?



From the front it looks like there's a choke point.... But from the side...



It's no holds barred.

So ok.... Say you can fit about 100 (I'm being generous) or so people within that small entry way before the actual "inner" doors.



This picture was taken (according to the NY Times) right before the doors opened. Do you really think that just minor pushing would have broken those doors??  I highly doubt it.

Then you have to remember that there were a set of sliding doors on either side of the entry way. Reports say that just the final inner doors were broken.


Not to be overly analytical (it is my job after all) but I think this is a clear case of Wal-Mart and everyone who they can get their hands on as being negligent in how they went about this whole affair.

I say give the grieving family all proceeds from sales across the nation that day and close every Wal-Mart for a single day in respect for the dead. Then take em to the cleaners both criminally and financially.

I'm an a$$ hole I know.

I agree with that.This needs to send a serious message.It has happened so many times before.....especially sporting events.Anytime a crowd is involved.....someone should be bright enough to predict a possible bad outcome(ya think??????).
