If you donot actually vacate the premises, does that not warrant the owner to contact the authorities to come and request that you leave?  What I am trying to say is that to have one of them come to ask you too leave, does that not take about 90 days?  Warding you with a bunch of extra time.

I think this was the case when I lived in So Cal many years ago.  It took that amount of time before they would come out.

i'm practically begging him to simply follow the letter of the law. if he shows up new years day and touches anything, i will defend my property and call the police. yes, he should have to file an FED to actually have us evicted, but he can show up and do whatever he wants and i'll have to go through civil proceedings to win.

Dont know about US but in UK rules only apply to residences/buisnesse not "lock ups" having sid that weld the doors shut!
Semi Geriatric ex-Honda mechanic and MOT tester (UK version of annual inspection). Garage full of "projects" mostly 500/4 from pre 73 (no road tax in UK).

Remember "Its always in the last place you look" COURSE IT IS YOU STOP LOOKIN THEN!

tomorrow is the moment of truth i suppose.... i absolutely refuse to let this #$%*er win. He is such an arrogant prick. I'm trying to stick to being 100% legal on my end (though you guys have some wonderful ideas... ;)) so that he'll just be #$%*ed if he does anything. that being said, i refuse to move my tools and lift out before tomorrow, because as soon as they're gone I can't work on anything and he wins anyway.

looks like we'll be having an all-day tinkering party thursday to wait for his sorry ass to show up and try something. the law does clearly allow physical defense of property.


the good news is that we have a lead on a really nice space 100yds away from the current one. there will be lots of buildout required, but it's a great space.

   You need a good lawyer who specializes in real estate law. Laws vary from state to state and are different between commercial and residential. Earlier this year my landlord attempted to terminate my self-renewing lease but didn't do it in a timely manner. I was fortunate to have the advice of a friend who is a lawyer specializing in real estate. Even though my landlord lied in court the judge still gave me 90 days before I had to leave. I didn't have the time to go after her for lying so I left after 90 days which was plenty of time to find a new place.

I hope everything works out easy and legal for you. It sucks that he want's you out, even if you get 30 days to do it. If you can't get out in time, ask in writing for an extension and offer rent. Document everything. Stand your ground and make sure he doesn't break the law. Don't break the law yourself or you won't have a leg to stand on. If he attemps to go through with the 8 day notice, call the cops and get a lawyer. If he doesn't but you need an extension and he declines, get a lawyer. Use all the paperwork you have been documenting as ammo for your lawyer.

no drama today at least. i've been creating the papertrail on purpose, and am definitely following the law (which isn't really too hard here). he heard rumor that we might have a new place in the works, and i think he is backing off waiting trying to take a path off lesser resistance. little does he know, i absolutely refuse to give the space up to him until at least jan 22nd. if he keeps being a total prick, i'll make him file a proper termination of lease. this is all he really has to do according to Oregon statutory law, but the idiot won't even recognize it. oh well, he's the one who's gonna be screwed this month when his construction plans can't begin...

Afterall if all of your stuff magically gets moved out one night into the parking lot and the locks are changed it's kinda hard for you to call the cops to let you in and you likely won't want to move your stuff twice. I am not saying he has the right to do it but he may have the balls to....wouldn't hurt for you guys to take turns showing up unnannounced and fairly frequently.

i'm definitely not banking on him having given up, just enjoying the discomfort i saw him experience this morning. i will be by often, and have made it very clear to him that we will sue the living #$%* out of him if he moves or damages anything. he can't really change the locks on the front door without giving new keys to all of the other tenants, and half of them are my friends. hell, my brother took over paying rent on the room we rehearse in.

fortunately, no news is good news. i think the letter i sent him gave a clear signal that i know my rights, have made a paper trail, and have every intention of fighting this. i found a CB-loving lawyer (from a craigslist ad selling off my stuff i don't want to deal with moving), who said that i've done everything well enough so far that there's nothing he could do differently at this point. if the guy breaks the law he says he'll be happy to help me sue the #$%* out if him.

did i mention that he admitted to a journalist for a weekly newspaper (the Willamette Week) that he hadn't given anybody proper notice and didn't believe he has to? wow.... that was really dumb on his part. i expect he's going to sit tight until the 22nd.

yeah, but nothing i plan on wasting my time shipping. it's bad enough when someone wastes my time having me meet them at the shop for something i told them i didn't have to begin with... half of these craigslist jackasses either think i have nothing better to do with my time than meet them for five minutes just for them to figure out that in fact i don't have what they wanted, think they are going to find a gold mine, or think i have nothing better to do than stand around and listen to them jabber about some bull#$%* for an hour when they aren't buying anything ("oh hey! do you have any stator cover mounting screws?"...huh? go to the hardware store, dip#$%*).

in any case, no not really. i got rid of most of it already. i have an untitled rolling K3 frame. that's about it.
