Just Got Screwed Today

Well, they just delivered the new to me 96 vf750 cd. Boy am I disappointed. My other bike was in an accident and I would have to say that it is in 100% better condition than what I got. After seeing this bike, I am totally pissed off. Not sure what I can do about it. Bought it from a dealer in WI. who represented it as in real good condition and running great. I only saw pictures that they took of it and now I have a piece of crap. This bike is only running on two and three cylinders and has been butchered up everywhere. Even the auto petcock assembly is just laying on top of the cylinder head. Bolt that holds gas tank on isn't proper size. Tank paint is ruined. Rust was on the upper fork ends. I could go on and on. Just makes me sick. Now I have to see if I can return it or get a partial refund of the sale price. Boy do I feel stupid. Just another sucker that has been duped by a dealer. Not sure what the law says about this, but I sure believe they misrepresented this bike. No way I would pay that kind of $ for this machine. I left a message on their machine and will call again Monday morning if they don't call me. DUMB DUMB STUPID ME !

Don't you have consumer protection?, in Australia that would be an easy fix....take it back....
The bike was misrepresented and is not what you payed for......ring the relevant authority for advice before talking to the arsehole that sold it too you.

First of all, don't start yelling at the guy.  Calmly tell him your impressions and tell him you'd like to refund the bike.  If he says no, then you contact his states Dept of Consumer Affairs and cancel your check or tell your credit card what happened.

You never get anywhere by yelling and making these wads defensive.
Yes- it's happened to me for a LOT of money.

Yea it happens to all of us at one point or another. Uncle Ernie has the right approach,.. Calm usually wins in these types of things. It sucks that it came from a dealer in a state that I live in. Makes me sad.. Hope it all works out for you.

Hate to say it, but its a heck of a roll of the dice to pay for a bike without laying eyes on it first. That being said, I sold a Black Bomber to a guy in Australia, and it worked out great. Good luck.

Check has already cleared....should have bought it with the credit card. Will lose the $400 delivery charge but this bike isn't even worth half of what I paid for it. Total piece of junk. I'll rebuild my old one and on it's worst day it will outshine this one on it's best. I will be pleasant and calm, but boy am I steaming inside. I thought at first, that I might keep it if they would refund some of my $, but the more I think about it, the more I feel the best route for me would to take the delivery loss and return the bike. Of course, that would probably mean that I would have to take it back there myself. That would add about $275 to my loss of the $400 delivery charge I already paid.

You have been ripped off, the bike shop or seller should be responsible for the shipping as well, as already said, go talk to your consumer protection people..

Hey man sorry to here about your situation. I know in North Carolina you have 3 days to back out of any transaction like that if you are not happy with it, or even if you just changed your mind. After talking to the dealership that sold you the POS and they still give you the run around I would call the Better Business Bureau and report them. If they are 1st class business they should work with you to do what ever it takes to make you happy to your satisfaction!!!!!  GOOD LUCK

  Yeah, definitely use the "Uncle Ernie" approach AND report it to the authorities! Fortunately for ME, I haven't been hit too bad like that. Hope all works out for you in this as well.

Take pictures of each and every item that you think should have been represented more clearly.
I don't think you should eat the delivery cost, either.
If the bike is really as bad as you say it is (in comparison to the bike you thought you were buying) there is no reason you should have to pay anything.
The mistake is on the sellers part.
$400 bucks is a lot to eat for a piece of junk, its even more to eat for nothing!

Depending on how much money they want to gouge you for... there's always the lawyer option, and sometimes all it requires is an official letter with their stamp.

Yeah, I'd agree on the taking pictures of everything you think was misrepresented.  And the calm approach.

And the facts:  what did the pictures he sent you show?  Something specifically different?  And, what did he say IN PRINT to you?  Conversations don't really count - he said, she said and all that.

And, not to be a wiseguy, but how did you let it happen?  Did he send you bogus pictures?  Did he send you pictures of only one side and the damage was all on the other?  Did you not interpret the pictures correctly?  Did you not ask for MORE pictures?  I mean, I can see not knowing about the running problems, but how did you miss the rust, the petcock damage, the butchery and the bad tank paint in the photos.

Saw the bike on cycle trader. called the dealer, and asked questions about it. asked for additional photos and they were sent. told about some minor paint chips and scratches and was promised that all would be addressed with some parts swapout with another bike that they had. asked for a 6 month warranty and was denied.they promised that they would fix all problems and that the bike was running good. Main items that I was told about was a small paint chip on the tank and the side covers had some minor scratching. Left rear tail light housing had some minor scratching of the plastic chrome. Bike was bought on a contract(more on this later) at the beginning of the month. I was never told that the deliver co. could take up to 21 days to deliver the bike after they picked it up on the 4th. Bike showed up at night in the middle of a snow storm. Couldn't get it started at first. finally got it going, but it was running on 2 and then three cyl's. pulled the bike into the garage and signed the delivery paperwork. THEN I started to get into the bike and really look it over. I wouldn't even pay 1/3 the price for this bike. Short list: lower forks corroded,uppers rust pitted, even the plastic chrome on the speedo is all bubbled off as if it was subjected to heat. Tank paint is totally fu#ked with a pea sized rust spot buy the filler cap. auto petcock not mounted, since the mount is missing, and just sitting on top of the cyl head. overflow/vent tube missing and even the bolt that holds the tank on is not metric. once the tank and side covers are off, the bike looks like it sat outside for a year after being run off road through some fields. Side cover rubbers all rip up. fork lock looks like someone tried to rib off the bike(lock missing and housing all beat to hell) fairing protecting rubber missing. rear wheel heavily corroded. that left rear turn signal not touched. frame is missing lots of paint in a lot of places that it shouldn't be. tool kit was there, but I haven't checked it yet for it's contents. owners manual missing. and this is just from my precursory inspection. But that was enough for me to reject the bike. now the best part. The contract that I signed had the vin # on it of the other bike that they had and were going to pull parts off of. didn't catch it until I got the title sent to me and realized the discrepancy. so in reality, the contract that i sign was for a different bike that what I received. that alone should be legal tender for a voided contract. so we will see what happens tomorrow. i called last night and left a message for them to call me. as for the dealers name...i will just say that they are in big bend, wi  If they don't cooperate, I will name them here and everywhere.

If the petcock was off, how did you get it started? I mean, if it was only running on 2 or 3 cyl could it be because of this? Have you tried starting it with the petcock attached, if that is possible? I don't know what you spent on the bike, but around here (south east Wisconsin) a bike that runs in any shape is worth $400 if it has all the parts (no matter the condition) then expect to pay anywhere from $800 to $1200 rust and all. Now there are exceptions but for the most part that is how it is around here. I say all that to say this, with out knowing what you paid, it sounds like you have the start of a good rebuild should you not get your money back. The contract thing sounds like a good starting point however I am no lawyer (I just play one in the bedroom  ;D ) it seems to be a good looking VTwin and after-market parts should be easier to come by then CB parts. Just my 2 cents..

were you told at any point that the bike was sold as-is? my brother had a similar problem happen to him with a dealer (which i told him not to go to after hearing horror stories about STAR CITY MOTORSPORTS in Lincoln NE) The dealer you used sure sounds sketchy since he's selling you a bike with #'s that dint match the title. could you even legally regester it?

For the #'s, they originally had the bike listed for 3900 and dropped it to 2900. with shipping, came to 3300. Title shows that it was a repo. found out it was voluntary. sort of like he knew bike was worth less than he owed.

Ok then that makes more sense. 3300 is too much for a restore of this type of bike. Hope you get your money back dude..

Hello from Wisconsin............You should have asked...........I sometimes travel past that dealer......stopped a few times.  Used crotchrocket city!  Maybe they shipped the parts bike by mistake!  With the vin screw-up, you should get everything back..........or keep what you have and tell them to send the correct bike.

I will be looking for your K4 at the Road Amercia event on June 11-13.  If you promise not to cry.....I'll buy you a beer!

yea, guess I should have asked my sohc4 friends to go check it out for me, but hate to impose like that. they sent the right bike but totally misrepresented it. condition is a 3 and I was told it was a 7-8. I will document everything with photos. the mix up on the contract will be my trump card. it pretty much voids the transaction. bike they sent was the right one, but the contract vin is different than this bike and title. we will see how they handle it Monday. one way or another, they will end up with the bike back cause I wouldn't keep it even if they offered to give me 2/3 of my $ back. that is how bad it is. i didn't but it to restore it. I'll be better off just spending the $ on my old bike and take it back from the salvage title to a custom title.

I still recommend talking to the relevant authority just so you know EXACTLY what you are talking about, nothing like doing your home work first. He will know the ins and outs of the laws and only use the bits relevant to HIM......you need to know the rest...Good luck..

So I called them today and they are trying to get me to keep it. I told them in no uncertain terms that I don't want it. Didn't buy it for a resto project. Salesman said he would talk to the boss and get back to me.....didn't so far.  Called the Ohio Attorney General and filed a complaint with them. Filed a claim on ic3.gov. Filed a complaint with the Wisconsin BBB. So now we will see where it goes. For those that wanted pictures..... First set are what they sent me in an email. Once I got the bike inside the shop garage, pulled the seat (wasn't even put on right) and the fuel tank to put a battery charger on it. This is what I found. Lots of dirt, rust, corrosion, busted + broken stuff, missing stuff, etc.

That's bad for sure. I would expect better for 3k plus the picks of the bike they took make it seem like its in great shape.. I sure hope you get some satisfaction from that place! GL... Keep us posted.
