kickstart lever

After figuring out that the PO had put the kickstart lever onto the clamp that holds it on... backwards. It is now fitting up where is should be. But when the footpeg has pressure applied to it, the result is that the lever leans out from its resting place and is about 6" out from where it should stay. Is this a common issue? is there a recommended fix?
When the footpeg is put back down into position, it seems to tilt the lever out rather than hold it in place.
Hope this makes sense as I do not have a picture at the moment.

Suggestions?
