Ebay deal gone sour, what should I do?
« on: July 02, 2010, 05:46:24 PM »
Hey Kiddos,

I'm fishing for some opinions on an ebay deal that went south (but I got my money back) on a set of carbs I bought for one of my bikes.

The set of carbs were advertised for my model and year of bike, no picture (I know, but they were sorta cheap to buy) so I won them and got them and... these are not the carbs for my bike- #$%*!

Throttle drum located inside instead of outside, a different mount bar on that isn't on the current sets of carbs I have on my bikes. And, the model numbers don't even match up, definitely not the right carbs for my bike.  :(

So, I then ask for my money back and ship them back and tell him how much it cost to ship it back. So, then he refunds the money back without the extra shipping back included, I didn't directly ask for it as it was kind of a dose test, just told him how much it cost me and see if he catches on- he didn't.  ::)

Well, the order was canceled but it still asked for feedback on the deal so I put negative, due to the fact the seller didn't sell me what was advertised and I wasted time having to take time out of work to ship them back and getting stiffed on the ship back.

So here is where the fun begins, enjoy.  :)

Dear xxxxxxxxxxx,

why did you leave negative...Please change it, I refunded your money without question, so what is the problem. if you don't fix this, i will take up a case with ebay and paypal. I will also leave neg for you as well..

My response-

You sent the wrong set of carbs and I got stuck with $12 for the return shipping because of your mistake?

Give me one good reason why I shouldn't put an overall negative experience and I'll change it.

His-

Dear xxxxxxxxxxxx,

this is why people just hose people on ebay...all the reputable sellers are tired of dealing with this nonsense. tell ya what, change the feedback and I will refund your shipping charge. The 1(good) reason is because I refunded your money at all, I didn't have to, so you know. I was trying to do the right thing, so how about it? If you don't then, like I said. I will file with paypal and ebay, then leave negative. And yes it can be done. I would rather just move on, as I am sure you would. If this goes further it will take more of your personal time to respond and deal with than you want to spend. Thanks

I am trying to think of what I should do next, should I just take the money for shipping and leave the feedback as neutral or should I stand on principal, tell him to shove it and take the negative feedback from him in return? #$%* the money, I just wanted an extra set of carbs that worked properly on my bike or that I could use for spare parts.  :(

How big a deal is negative feedback on ebay? I don't think one negative feedback will affect me that much, I only buy stuff. This is the first time someone sold me something it clearly wasn't, the first deal I had go south. And, it was an overall negative experience for me, hence me leaving negative feedback.

Thoughts, opinions?

Dukie, it's my understanding that sellers cannot leave negative feedback for buyers anymore. What he is probably referring to by -

Quote

 - is that he will leave you a 'false positive', in other words he'll leave you a positive mark but with negative wording.  I say #$%* him!  Don't give in to his extortion, the whole experience is gonna be way worse for him than you. Tell him it's worth $12.00 to you to know that eBay & PayPal will F him in the butt by witholding his funds for future sales.  ;) ;)

This guy is about as full of #$%* as it gets.  No, he cannot leave you negative feedback.  Even if he leaves you a positive with negative remarks you can report it and get it removed.  He's also full of #$%* in saying that he didn't have to give you a refund.  If he had refused, a dispute with paypal opened by you would have resulted in you getting your money back anyway.

If he had been more reasonable in his emails to you, and had been willing to refund your return shipping without the threats and without requiring you to change your perfectly reasonable negative feedback, I would have suggested changing the feedback, but this dick deserves the negative you gave him, and future potential buyers deserve to know what problems they may be taking on by purchasing from him.

Leave the negative and tell him to EABOD!

Considering his attitude, I'd probably even go in and add a follow-up on the negative you left letting everybody know he tried to extort a positive feedback from you just to do something he should have offered to do anyway.

Also, let us know who he is so we can all avoid his auctions, and be sure to tell him you just let thousands of potential buyers know what an ass he is.

Yeah, like I said, the negative feedback for me is something I am not sweating, I have 100% positive and I only buy on ebay- heard too many horror stories about selling.

Oh, so negative feedback from seller to buyer doesn't exist, wow what a turd.

Yeah, even the ship back fee doesn't phase me too much, I'm just pissed he sent me the wrong set of carbs and what a waste of time it has been for me in the end. I was looking forward to having a spare set for the VFR's since a PO busted one of the intake ports on my first bike's carbs.  :(

How about you spend no more time on this asshat and just leave things as they are. You left negative feedback which will stay. Don;t give him any more time he got more than he deserves.

That's what I figured, negative feedback left already, I'll let him know it's gonna stand.

Thanks.

Yeah, it's jerks like you that make life hard for honest sellers by not accepting the wrong merchandise they are sent.  You should be ashamed of yourself!

Since he did refund your money, I'd say it's a bit of a gray area so it may have deserved a neutral feedback had he politely asked you to change the feedback from the negative.  But since he's trying to intimidate you, I'd keep it negative.  Especially if your comment is factual (ie "sent wrong part, corrected later, shipping not refunded").

I honestly say take the hit on cash, ebay is awful and I avoid it at all cost. However it dosent matter people like this suck, but they populate ebay, you honestly get hosed no matter what. Chances are he got hosed on shipping and prob lost money on the sale, so he is trying harder not to lose more, then again I give everyone the benefit of the doubt.

regardless if you lose the 12 bucks on this, just tell me and I will give you the 12 bucks on paypal.

I've had over 700 transactions on EBay, and in that time, a handfull of them have gone sour. In most cases a friendly email has elicited a refund and we've left each other positive feedback. If the guy refunded your money without any argument, I can't see why it was necessary to leave him a negative. Just my two cents, of course. Cheers, Terry. ;D

Except he didn't.  He refunded the purchase price plus original shipping, but not the cost to ship them back.  It was the seller's mistake, so he should eat the cost of return shipping, not the buyer.

ebay frowns on sellers trying to extort positive feedback from buyers. I'd file a complaint with ebay, it might get you your $12 back and/or some satisfaction.

I agree Gordy, the seller should have refunded the 12 bucks, but maybe a friendly(ish) email might have elicited the 12 bucks before Dudie went ahead and left him the negative? I'd imagine that once he saw the negative, any thought of refunding the 12 bucks probably went right out of his head?

negative feedback is a scam i have a few of them and it hasn't affected me at all. tell the guy "you wont be wasting your time because you don't care". you got your money back as far as shipping goes consider it as a lesson fee.

Screw the cash, he can keep it.

He demanded I send him a response or he would "Take action", so here is my response.

Me-

Dear xxxxxxxxxxxxxxx,

Look, you do what you have to but I'm sure they wouldn't want to hear that you tried to extort me with threats for positive feedback. I was on the verge of turning it back until I got that response from you, very bad form.
I suggest you take your lumps on this one, you #$%*ed up and sent the wrong set of carbs and wasted both of our time and money. If I were you I wouldn't pursue this any further- let this one lie where it is.

I want nothing more to do with this poo head so that's it for me unless he wants more.
God, all I wanted was the right set of carbs... is that too much to ask? :(
