HELP?

Okay, my girlfriend owns a VTX1300 that she bought when she was married before. she let her friend's husband take over payments over 2 years ago but the title is still in her name. he has been paying the payments, so she says. she says she checks with Honda periodically to make sure. when she told me this, i told her she was nuts and taking a huge risk... apparently he could not get financed for it at the time. i think she should either take the bike back or transfer it into his name...
thoughts, potential pitfalls...

ya, unless she really actually trusts the guy... i'd get my name off it too. she doesnt need to check with honda, if dude misses a payment, honda will find her. depending on local laws and what she signed, they can take payment. my dad cosigned on my sisters caddy, big mistake, she went on vacation and forgot to pay the bill, well my dad signed something and they promptly took payment plus some ungodly fees for the trouble straight from his bank account. sister made everything right, but it was a mother #$%*er...

From personal experience:

A former girlfriend signed for a bike for her boyfriend.
They broke up when there were 2 payments left.
She started dating his brother and gave the bike to her new boyfriend.   ???

The first brother had to make the last 2 payments.

Wierd huh? but it does happen.

that's what i'm screaming. last night we were talking and she was like, "wow, i never thought about all that." she had two bikes at the time and wasn't riding that one. she just thought she was helping someone out. i told her today to call the dude and give him like 30 days to either refi himself or give it up. i'm sure he'll want to keep it since he's been paying on it for 2 years. hope this don't get messy. either way, i told her. this guy has everything to gain while she has everything to lose....

she says she does not want to be an @$$hole. i told her he was the @$$hole for asking her to do that in the first place. if you're credit is too $%%y to get the bike, then you dont need the bike....

he didnt answer. she sent him a text... ill keep you posted

btw, this all started when he called her last month and said he was having trouble making payments... none late so far. but #$%*TT

if all else fails, and the title is in her name.... call and report it stolen, and tell them you know where it is. but than again, its only a vtx, how many payments are left?

note would be paid off at the end of 2012. she still owes $6050 on the bike. bought it brand newsky... she needs to get away from it or get it back and sell it... she says she would keep it. she can afford it. i told her i dont care what she does as long she gets away from this mess.

yeah i do and he's a county deputy where this guy lives... hmm. hopefully it wont come to that. we'll see

IFWY, just make sure you do the deed while he's on duty, and he's also fully aware of the situation.

he can go get financed for the remainder of the loan and she will transfer the title and it's his. but if he refuses to do that or return her calls, that's what it will come to. that is one of the reasons it's a bad idea for both parties... legally, she could wait til he pays it off and then come take the bike.

its only called an INVESTMENT when he legally takes over the title.
it would be called RENT, when he gives back the bike.

the choice is his to make.
or he can chose not to choose. 
in that case, he made his choice. :D
