Has anyone purchased a bike without a title?
« on: January 08, 2011, 07:17:42 AM »
As the title suggests, I'm probably going to be buying a bike, well a frame without a title. I have been wanting to build an old yamaha and I found a guy locally with a barn full of goodies. He has a bunch of parts, frames, engines, fenders, you name it, but they don't have titles to them. I was going to go out today and look around and feel the guy out to see what all he has.

I'm thinkin I shouldn't buy anything today and wait to call the dmv Monday with the vin numbers to make sure nothing is stolen. I know there can't be any liens on the bikes its too old for that.

But what do you do? Do you get a formal bill of sale and get all the information and both of us go to a notary or something?

I'm sure it differs from state to state and I'm in Tennessee.

Any experience out there with anyone doing this sort of thing?

Thanks in advance.

call the dmv first and see what it takes. Here in indiana its hard to get a title.  Its time consuming and lots of red tape.  I have a buddy in michigan title my stuff. But i dont buy with out a title much anymore, unless its a parts bike.

with out a title dont offer much.  A frame with out a title is hardly worth anything.  I have a CB750 frame and swing arm you can have :)  if you ever come to indiana.

If you question is if anyone has 'ever' purchased a bike without a title, the answer is Yes.  If you're asking if I'd ever do it again, the answer is No.  You really will not understand how good the advice is to never buy a bike without good paper until the put the handcuffs on you and you find yourself desperately looking for a good lawyer.  No need to ask me how I know this to be so.

I know full well that in most cases this isn't a problem, but it was one time for me, and that one time cost me more trouble than every un-papered bike on earth is worth.

I have and would do it again given the right bike/price.
In TX, it's not a deal killer, just need to get bonded title, about $100.

If the bikes are his, why can't he get a duplicate??

i talked to my local PD and they gave me the address and name of the last registered owner

they told me to send a certified letter to the address asking for a title or bill of sale and say all you have if the frame not a whole bike.....if they sign for the letter they have 30 days to claim if you get the letter back take that and a copy of the letter you sent top the dmv and they will let you apply for an abandoned title

sending my letter out today, if your lucky like it looks like i am going to be the person wont live at the address anymore any you will just get the letter back

good luck

All the bikes I have bought have had no titles.  Here in Georgia all you have to have is a bill of sale for vehicles over 20 or so.  Plus I always get a VIN verification from the local county mounties for good measure.

It really depends on the state... AZ is pretty easy, NY is hard as hell! Some states don't even title bikes after they're 10 years old!

It seems like it would be pretty easy. I didn't buy anything from him, even though he had a treasure trove full of goodies. I'll find out the info from the county clerks office tomorrow and see what they say.

I have heard of sending the letter to the PO, waiting 30 days for the response and get a title after that. Maybe this will be the same ordeal.

Let's see if I can remember everything that was said..

I went to my county clerks office where I usually take my registration/title stuff, get my tags etc. The woman there said that first of all to purchase a vehicle without a title is against the law.. Oh well people do it all the time for parts bikes.

She could run the VIN number and see that it wasnt titled in TN, but it wasnt stolen and there was no liens on it either. But since it wasn't title here I would have to contact the State, and request the Vehicle Information. However when I left I called from my car, and immediately the woman from the state said they should know at the County Clerk's office that the State cannot provide me with that information. There is a new Federal Driver's Privacy Protection Act for the state of TN, and I would not be able to get the information from the previous owner.

See originally, The woman and the Clerk's office said I could call them, get the PO info, go the post office send out a Registered Mail with Return Receipt to the PO's address and request the title. Of course if there was no response I take that Registered Mail when sent back to me, bring it to the Clerk's office and boom have a title.

However now that the State can't provide me with the information the only thing they told me to do is get a Notarized bill of sale from the guy I am buying the bike from, and get it titled that way through the Clerk's office. But the woman at the Clerk's office said, since the guy isn't the Actual owner of the bike, when she sends off the Notarized bill of sale to the State, it will be worthless, and not even worth the paper it was written on, because that man is not the actual "Titled" owner. So it will come back and I still won't be able to get it titled. There was also mention of a Lawyer having to get involved to um do some sort of request to the state for me, something about getting them to release the PO information to be able to send off that Registered mail to the PO..

Basically, some how in order for me to make this work, I have to find out who the last person who had it titled, send off the request, blah blah blah, but there is all this red tape due to the Federal Driver's Privacy Protection Act.

The fee is minimal once I apply for ownership and get the title it's like $5.50. I have a good friend who is a lawyer, I guess I'll discuss it with him, but as of right now it seems pretty darn difficult.

If it was registered here in the state it would be no problem at all, but since it wasn't I have to go through the State, so they can run the national search and some how have them relinquish said info to me.. But I'm not sure I can do that without a lawyer, I'm not sure..

Ugh.. F'in politics.. Atleast I haven't bought the bike yet..

I've seen some people hacking off the necks of the frames, and just selling them with a title, hahaha.. Geez desperation at it's finest!

Good luck to everyone else outside the State of Tennessee.. But if you were here trying to do it, I'd say go find another bike with a good title.

Oh and, I thought I would forward what was said here with the Owner of the bike right now.. He has been trying to help me along the best he can.. Pretty nice guy. But maybe ask him if he has the information of whom he bought it from, address or anything like that..

Do you guys have any thoughts on that, or what questions to ask. Or should I just say screw it. Even though the bike is so cheap ($350), hold off pay a little more and get one that's titled?

Yes.  And I've tried to go 8 seconds on a 2000lb bull and I wouldn't do that again either! ;D ;D ;D

So just a quick check:
-is it rare?
-does it run?
-is it super clean?
-is it free or VERY cheap (<$100)?
If the answer is yes to two of the above it might be worth the hassle and risk.

It is a proven fact that modifying a SOHC Honda in any way will bring on the apocalypse.

I wouldn't give up yet. Sounds like you are getting two stories from the state.
I would have said I bought this bike and need to title it, what exactly needs to happen?

hahaha!
Rare- XS650, so no.
Run- it's got 140psi of compression, but the bike itself is a basket-case, so I don't know
Clean- the engine, frame and wheels are pretty darn nice
Cheap- Well it's the cheapest one I have ever found at $350

That's what I was hoping to do here as well. However that seems to only work if the vehicle in question was titled in the same state in the past, if not it seems I have to go through the state and have them release the information some how so I can do this with this bike.

It does seem that way, I am going to call again tomorrow and try that out and see if I have any luck.

Well why do you say that?
I know they are a dime a dozen, but I have see bikes in worse condition trying to sell for over $1000, people seem to think these bikes are the bee's knees..

It's just the cheapest one I have found in the condition it is in. I thought I would atleast entertain the thought! ;)

Yes, dime a dozen and not as valuable/collectable as a SOHC. Don't get me wrong, they are good bikes, but I think you are finding out, not worth the trouble.
