So, let me say first, I haven't had this bike very long and I have already made a mistake, instead of throughly checked the bike first I have been focused on the 1st gear issue. With tjhat being said I went to drain the oil so icould pull the pan and opps, no oil in the bike. Thank the lord the eng didn't sieze up during all my test drives. So I did pull the pan and found only minor debis and metal in pan. So of which I believe came from the cappy after mkt plug someone cross threaded into the oil pan. I have tried to post pics both thru my phone and computer but it keeps saying file entity too largve. Don't know why. Anywho, would it be worth it to fill up with oil and try to ride again? Could the lack of lubrication be causing this issue in first, or are we still leaning twords trans issue? Thx

Put 3 quarts of Rotella 15w40 in and give it a try.  I have three instances where I have carelessly run engines or transmissions with no lube for short times.  All 3 were OK after fresh lube, cleaning, and some riding time.
Thx king, I was going to try that anyway and see what happens. also thx to the wiring diagram I got from you a month back I have been able to create a new wiring harness for my bros bike. Thx again
