Accident yesterday
« on: September 02, 2018, 08:45:12 AM »
Hi all
Yesterday morning country road coming out of sweeping left hander, about 20 yards ahead were two ranch trucks blocking the road both directions chatting...i braked hard but made impact between both vehicles about 12 mph cosmetic damage. I have witness insurance contacted.
I have damage to gen cover impact pushed parts into windings, I was able to ride home no charging..opinions on everything being ok, with just replacing cover..waiting for contact from other party's insurance..

Glad you are ok , if its through insurance charge as much as possible to replace all the bits . screw the insurance co.'s , they really only care about bodily damage that will cost them big $$$.  they like taking your money but they don't like giving it out . ( get a couple of estimates from local shops and submit the highest & fix it yourself ).  Ride safe-    Stator ,rotor and cover at the min.  check the runout for a more serious problem .

Yes, do check the flywheel at the end of the crank that goes under your gen cover for a wobble. I laid down a 750 once and broke that cover and after replacing the tank and other necessary parts was disheartened after I put on a new stater cover and because the end of the crank got bent there was not enough clearance for that rotor to turn inside the cover causing the crank to lock up and not turn  :-X
  Glad your not injured !

Here is picture of road ...i started the Honda to check for bent crank.. it was ok...then I noticed oil shooting out...plug blew out from oil gallery lol..
The road is a long sweeping left hander ...landscape before your straight...not enough braking power..looking at my damage I would say 1k ...most expensive  repairs would be gas tank repaint, has  scratches down to metal..

I'm a big fan of brake upgrade work and emergency stopping practice. I cupped a front tire on my triple disc 76F doing just that. Then got a new set of Avon road riders.

People are dumb. This morning I was cut off by a garbage truck. This #$%* happens so often (especially in the city) it's sad. In the last two months I have had 3 "alright here we go" moments. This one didn't even phase me because it's been happening so often. I probably need to learn to use the front brake more aggressively. I'm dragging the rear quite a bit.

You’d better learn to brake properly. More stopping power up from than in the rear, plus aloss of traction on the rear.

Driving and riding, you make your own luck. Good skills, practiced regularly, good equipment in top condition. Eyes always looking and planning evasion. If your tires are crap and your brakes aren’t as good as can be, walk. It’s safer.

Have a look around in traffic at lights. Notice the tires of the cars and other vehicles adjacent to you. People are negligent idiots and you should always expect they will not favor your life over their convenience. It’s entirely up to you.

Yeah, I am always making sure my brakes are good (rear drum adjusted once a week and front reservoir regularly checked and bled). I am also pretty aware of the cars around me, (lights, tires, where is the driver's head looking) I think if I weren't I would have gone down by now. I DO need to practice utilizing the front brake more and more smartly, though.

Rear brake is nothing to use too hard. Risk to loose control, sliding off. That's my experience of my CB750 since many years. It has dual front brakes since 2016, finally brakes.
Important to have control of the road, expect the unexpected behind next corner and be prepared for others bad choices. See the opening where it is possible to drive, not brake in panic.

Gearbox and front brakes is what I have used. Rear in lower speeds.  I can remember many critical situations when I did not brake at all, if I did I should not be here. Rest in many pieces :)

Well its the 18th and no call back from OP insurance... state farm... so i called today with the adjuster person that decides, amazing its taking this long, they are waiting for statements from other party...coming up to three weeks, i caln't do anything to Honda until decision is made.... I was told i will be partial at fault ... there is a California law stating this... Insurance is good at taking your money but not putting it out....update to follow..

Because you hit them both rather than crashed into the one stopped dead in the road or what law makes you partially at fault.
Good luck getting it sorted out. Can the police apply any pressure to the other guy to get his statement in?
Would expect they have a deadline for filing that paperwork.

Make a call to the insurance comissioner and see what they can do. Plus MAKE your insurance company do what the f&%#$ you are PAYING them for.

I freaking hate insurance companies!

My son who is a designer for Trek bikes ( and rode competitively and rowed in college ) was riding his 6k Carbon BMC bike here on long island and was hit by a car . Took state farm to court for the damage to the bike in small claims court . He won the 1st decision for $4800 & state farm appealed ( corrupt new judge in this court , friends of attorneys office that SF contracted to here on Wrong Island and he got $0 , after 13x going to court ! Plus about 6 trips up from Philly where he was going 2 school . He stopped riding & rowing ;(   , Started working for Trek and rides for them now :)
SF attorney said to me that SF would pay $4999 to his firm out of the 5K claim to prevent paying anything to my son !!
You need to lawyer up IMHO , that was our lesson , i hate to feed the system but sometimes you have to. Like i said on my earlier post , the only thing that scares them is bodily damage.SF sucks !  SF was actually charged w/ Rico act violations by their own employees years back after screwing policy holders after a hurricane . Total bottom feeders, heres a current rico suit against them .https://www.insurancejournal.com/news/midwest/2018/08/31/499927.htm
Good luck

ps - you always need to know what's ahead @ speed , 40+ years riding on Wrong Island. Had a psycho try to run me off the road on my Ducati last year and she smiled while doing it . I use a go pro just for documentation now...

The adjuster will almost certainly argue that he was going to fast around a blind turn.

That’s an irrelevant argument. If the Police did not charge him, then no assignment of fault for driving conduct can be asserted by an insurance company.

I didn't say I agreed, I am just saying that will be their argument.

Adjusters don't make "arguments". They settle claims. Presuming what they might say is superfluous.

Fine, determination then.

This happens all the time. I was in a car accident in 2015.  I proceeded into an intersection after a stop where cross traffic didn't have a stop sign (I thought it did). It was clearly my fault and I said so. In the end my insurance said the driver who hit me was 30% at fault because it was very low speed in clear weather and he should have seen me pulling away from the stop sign and been able to stop before he hit me.

The job of the adjuster isn't to be fair, it is to reduce the cost to the insurance company.

I know all about that.. coming up two years since my car accident with the wife.....driving down a two lane street west.. two lanes south this nineteen year old girl cut across the double yellow lines to get to gas station.... bang 40 mph impact my Passat hit the jeep center of its front wheel....the wife came off worst, medical bills almost 5k that we had to pay up front.... jeeps Allstate insurance paid for our car, but made us wait one year before they would pay us for pain and suffering.......... me $250.... the wifes medical bills plus $800....... we got an attorney they take a third not counting medical bills, almost another year settled a few months back.. we did better but not a lot......... so yes i was going around that turn too fast, modern day brakes with twin rotors  i would have stopped a few feet away from the vehicles... lesson learned........  :(

Higher friction compounds are available now and twin brakes up front can help but only way to get modern braking performance is with restomod of front with Berringer & similar or fork & braking system change. These old bikes didn't need to stop much faster because cars of the day could not either.
Good luck getting this sorted, insurance companies really suck in their cost containment and treatment of people anymore...all bottom line.
