It is a crazy story. It's highly covered here in Canada. Interestingly enough, the spot where the civic was parked on is actually a straight away with 2 lanes and an on ramp on the right Lane. I'm wondering how it really went down. Maybe the guy on the harley was following a car too closely and the car turned at the last moments where he did not have enough time to stop or turn. Regardless the women in the civic is in wrong. Rip rider and his daughter.

Is that seriously how your mind works TT, pathetic...?  ::) I would save my loyal dog over a hell of a lot of people , the ignorance and selfishness growing in the world today disgusts me. Unless the woman did a panic stop to save the ducks, and after reading several articles she didn't, she was already stopped and out of the car, undue care and attention on the riders behalf has contributed to his own demise, he was estimated to be riding up too 20MPH over the limit? thats illegal right there.... Making her solely responsible is pathetic. ...You know I read the other day " take ants{or a lot of single species} off the earth and the planet would die, take humans away and the planet would thrive".... Says a lot doesn't it...

Look at it this way; IF the driver had rear ended a motorcycle, guess who would have been charged?
I don't know if the biker was tailgating; if so, he's been cured of that idiotic habit.

Randomly stopping in an active lane for something not even a hazard on the road is criminal, and reduces any trust for those sharing the road or having expectations for others to behave with some concern for others.  Prisons are for stupid people that have no regard for others' lives or well being, (even if I was being sarcastic with my earlier comment).  Lanes adjacent to the medians are fast lanes, are they not?  Parking on one for airhead reasons should certainly be punished.   The fact that it happened in "totally safe" Canada, I find interesting.

She is directly responsible for taking two lives, so she could have some pet ducks.  She gets off lucky having society literally pay her for the rest of her life.

Why can't people be held responsible for their actions, intentional or otherwise?

With the mentality pervasive in this forum, why aren't there outcries of banning/restricting, medians, non-fenced roadways, motorcycles, cars, or at least only letting the responsible operate them?    That way it will never happen again.  It's just common sense, right?

Couldn't be the person at fault.  It must be the evil machines, or other devices created by mankind, that made them do it.

Not to get out of subject but what's wrong with California?

I should mention, Montreal is in the province of Quebec. Quebec is known for aggressive/stupid drivers. Not my opinion it's what everyone says around Toronto.

I'm wondering why the rider didn't see the car stopped n front of him?

Before telling my wife of this story, I asked what she would do if she saw ducks crossing the road?  Without hesitation, she said she would stop.  I probably would too.

So what theyre saying is this

The harley was following a car a safe distance in front of him in a TWO LANE highway in the left lane.

Although it was a straight, the sun played a factor. Which made it worst

The driver in the car could barely see the car PARKED IN A TWO LANE HIGHWAY. The driver could barely see it because it was of a dark colour.

The animal saviour was dumb enough to park her car WITHOUT the caution lights on. This makes her car completely invisible.

The driver was able to swerve last minute once the driver knew the car was parked on the passing lane.

Now the rider on the other hand. Hand to factor in...
The sun, invisible car, split second reaction.

Keep in mind that when a car in front of you does a sudden movement, you tend to watch that car as to wonder wth is wrong with the driver.

So now at this point the moment to put your eyes back to whats in front of you, you have less time to react. Base on the pictures, the harley tried to avoid the car but still hit the right rear of the parked car.

stopping in the fast lane is just plain stupid, ducks or no ducks. no one expects a car stopped in the fast lane .

What a load of rubbish, this is your opinion/assumption, I've been riding bike as a primary form of transport for a very long time and have come across a few broken down cars in the fast lane as well as been behind accidents right in front of me, I know if i were speeding, my chances of avoiding the situation would have been harder if not impossible, I am NOT saying that the lady is devoid of any responsibility, I'm saying they are BOTH responsible, you can't break the law and be devoid of responsibility, as Steve said, if you run up the back of someone for any reason you are usually at fault....

They're both responsible, it was totally irresponsible to park in the fast lane on a 4 lane highway people get killed all the time doing that, ducks  smucks I would go through that every year here my wife would spot a turtle going  across the road and we'd stop and I would pull to edge of the road whilst yelling watch for cars and if I couldn't far enough off to the side I'd go to a place where I could this is on a 2 lane road if she couldn't do it safely then she's at fault, and having driven a bike for 50+ plus years as you speed up you have to become more aware of what's around you if you don't you're dead. So both responsible. Do I think the young woman should be punished yes, I think that harsh reality has to intrude into the Pollyanna esh world of the do gooders. The bike driver has been  corrected.

So lets say you were following a truck. Then the truck suddenly swerves out to avoid a dead deer ahead of him. Keep in mind the truck swerved at the last second. U have less than 2 seconds to avoid it. But because you fixed your eyes on the truck due to your safety u now have 1  second. This isnt enough time tto react.

This is not enough information. 2 lane, 4 lane ,directly  in the lane  , day or night.....???
If she stopped in the left (fast)lane of a 4 series (freeway) or the on coming lane of a 2 lane road, she is just plain stupid!
However it could just as well been a disabled truck. I have seen them stopped dead in the centre lane of a multi lane freeway.
It seems odd the bike rider didn't see the vehicle on an alleged straight road.
As for prison, I doubt that will be the actual penalty.
It goes to show you must ALWAYS stay alert!!

Regardless i dont see heavy bikes with 2 people on board stopping safely 4-5 car length ahead. The reason i say this is because the harley was following a car in front. The car almost hit the said idiot animal saviors car. This leaves the harley a few car spaces ahead to make a maneuver/stop at 70mph. Given that the rider was (50+?) his reaction time couldnt be good as it once was.

Jimsun. I don't think the car was completely invisible. If anything you would see the cars rear light reflectors against the Suns light. Civic is at fault yes. But I have a feeling that the harley was tailgating the car in front of him  too closely where he did not have enough time to react. Add on to the fact that he was going 20km over the speed limit. Both at fault. What if it was the women that parked died? Something to consider.

That's a very good point.  But, I expect the jury of her peers did have all the relevant information and found her guilty.

Not that that matters to anyone with a supreme opinion thousands of miles of distance between the incident, and the actual facts of the matter.

Here in the US, this is called arm chair quarterbacking, for disengaged observers to project how the game should have gone in their perfect world, and looking to place blame on their favorite villain du jour.

As for prison, I doubt that will be the actual penalty.

I expect you are right about that.  After the hoopla subsides and those in power feel their message has been sent to the masses, she will be shown "mercy" for the empowered to gain the needed recognition.

The villain becomes the victim to be saved by a voter's hopeful.  ...and all is "right" in our corner the world.  Sleep well children.
