screwed on and by Ebay, what can I do ?

Hi

I started a thread in the "bad sellers" category, to inform you about this ashole seller Andy Cepok - AC Motarradteile.

I opened a case and Ebay said that I shuld sent the item back and then get a refound, I couldn't send it back cause I sent it back earlier and it was the exhanged part that I didn't recieve.
I explained this to ebay for the 12334241 time in this e-mail:

"I thought I was clear. But I will try again.
 
I've already sent the item to the seller, that was nearly 3 weeks ago. Since the seller asked me to send it back the cheapiest way to exchange it, I did so and therefore I didn't get any tracking number. I E-mailed the seller, and he answered that he got the item and soon send a new one back to me. This would be proof enough IMO. I'm attaching a printscreen of the email, as a proff of that the seller have received the returned item.
I never returned any new item, and thats what I want.
 
The problem now is, HE DOESNT SEND A NEW ONE BACK. I've alreday paid for the "return shipping" ( Which IMO is crazy when the seller sends the wrong item).
 
Once again.
-I sent back, for exchange.
- He received, was supost to send a new one to me.
- I never got a new one,  and thats what I want.

 
So I can't do either number 1,2 or 3.

Ebay didn't answer. and since There's nothing to send back they closed the case and Im 100 dollars poorer.

Anyone have a recomondation of what I should do ?

Did you use a credit card for purchase??? File a complaint with your credit card company , they MAY refund your $$$ and go after seller for fraud!!!!

I paid through paypal...

I've contacted "Europe customers safety" and opend a file agains him, and hopefully I get my #$%*. Otherwise Im shure the economical damage of loosing customers would be bad for him. I dont like being screwed.

The bad part of this is you should have got tracking number,or some kind of confirmation. PayPal will be on the buyers side 100% but you need a confirmation that you sent the item back. I don't know if emails would be considered in this case. If you use a credit card or Paypal you are a step ahead of the problem at least.

Not always. I had a bad seller tell PayPal that I returned the wrong item and they reversed my refund. Never provided an opportunity for me to have countered the false claim or anything.
I've lost a lot of confidence in the PayPal protection program.

If you didn't do the return the "E-Bay Way" using all their directions vs working directly with the seller outside of EBay there is a good chance you may be screwed. This would include any/all communications with the seller going through E-Bay only.

I bought a NOS tank only to receive a used tank. Made a few E-Bay communications before pulling the trigger for $700 to be absolutely sure of what I was buying. They send me the used tank. I communicate with them through  E-Bay and they quit replying. I offer pictures to the seller and E-Bay. The box it came in even indicated a defect. It took a lot of effort but E-Bay took good care of me and sent me a pre-paid return label and credited my account.

Being a good E-Bayer takes practice and you may make a few blunders along the way. Document, follow all E-Bay procedures, be very diligent in expectations and communications, ask very specific questions before buying and above all else read the sellers feedback! DO NOT ASSUME ANYTHING WHEN BUYING ON E-BAY
As of today 3/13/2012 my original owner 75 CB750F has made it through 3 wives, er EX-wives. Free at last.  ;-)

This fella has a ebay store, 6000+ motorcycle items and his feedback rate is like 97% possetive or something. So it felt safe...

I have the confirmation from him... by email.. I dont know if thats enough..

I emailed the seller about Im filing a fraud case against him. He then said that if I change my negative feedback against him I would get my things back...

Victor, The seller is calling your bluff!(POKER TERM) If you pull your NEG. comment then he has you by the family jewels. He most likely WON'T send you your parts and then tell E-BAY that you have changed your mind and don't have a problem with him..  If it is a mutual trust issue , tell him WHEN you get your parts that were ordered YOU will then pull the NEG comment and state the situation has been corrected!!

 Enough NEGATIVE comments and passing the word throughout EVERY forum about his business practices WILL hurt his business and he knows that!!!
Don't threaten because that can be used against you with E-BAY.

Only when a deal goes totally south do you want to whoop out the negative feedback nuclear option, let the Feebay resolution stazi do their work to resolve an issue if you are wronged. If you still get crapped on after that you need to rethink if you want to deal with Feebay after this.

When shipping back items ALWAYS do confirmation delivery notice, gives them no wiggly room to wiggle.

Its not a bluff, I have opened a file with the consumers safety europe.... And i didnt remove the feedback, as i told him. I wrote in the feedback why it was negative, if i dont want that kind of feedback, then dont send #$%*ty things..ASAT !

Ebay is out of the picture, they didnt help a squat, incompetent as f*ck ! But threaten .. hmm, I told him how I felt and that I dont like to be screwed and as a man of 2012 Im going to inform the people in my surrundings about this fella... information, not threat :D

Yeah I learned about the shipping with tracknumber now, didn't really think about that beafore, the seller and i came along nice and he told me to send it cheapest way possible... so i did..
