Well you`d better get yourself busy organising a welcome home party for the old bloke, let him know just how relieved and happy you are

           Kinda funny you should bring that up. About a week ago, my Dad said, " When this is over, we need to celebrate in SOME way, because it will be well deserved!"   ;)   Also, you gave me an idea that I should look for a VERY special "Welcome Mat" that would greet him everytime he is at the door.

I'm not sure how your gaurdianship would negate his will...but perhaps I'm an idiot about those things.

Thats what lawyers are for.

Always thought lawyers were like nuclear weapons....

Hate to use one because it screws everything up for 10,000 years...but ya have to have one because the other guy has one.

          Tim, to go for Guardianship, would mean that I'd have to prove that my Dad is "incompetent" and that would mean that he didn't know what he was doing when he instructed the lawyer to draw up his will. And, it would kill me to have to try to prove him "incompetent", especially when he doesn't seem to be AND his family Doctor doesn't think so either. Don't need to use Lawyers very often, but this one has been a Godsend!

        :D Ya know,  I just can't wait to see what David will think, when he finds out that his name is no longer on the NEW title for the Dakota and MINE is! Kinda got a rise out of my Dad, when I suggested that we fix the Dakota and then see about selling it. His response to that was, "What if I need to HAUL something?" I added that I could get a hitch put on the minivan and he said, "I don't WANT a hitch on that one!" So, I relented and said, "So, I guess we will keep the Dakota then and things quickly settled back down. They didn't get too bad, but settled quickly enough. Of course, right now, we need to get this thing that Skank has started up on again, FIXED! Now that raises a question: Wonder if SHE'S been Fixed? ??? ::) :-X

Anyhoo, I max out on riding for a few days, and I miss a lot here. First off, as far as guardianship goes, the root is "guard." Think about it.

Second, if achieving guardianship is the way to go, feel free to prove your dad is incompetent, inconsiderate or incommodious. It's a legal maneuver; you and your dad know the truth.

As far as overcoming, I've never had to deal with anything so severe, but I have my own way of hitting a determination that simply makes things happen. It goes beyond "failure is not an option" or "visualizing the goal." What I do is to fully believe that something I am going to do is actually done. I only do it for things that are vitally important.

When I say I believe it's done, I mean it in my heart. People will ask me how something is going, and I'll tell them it's done but it just hasn't happened yet, and I really feel that way. Because it's done, all the details are done; it's just a matter of figuring them out. Hurdles mean that something will be gone around or overcome. Because it's already happened, failure is an untruth.

Mebbe it's like when you do a maze on paper. You know where you start, and you know there is at least one way to the exit. The in between is time and effort.

It's a state of mind, and it gives me tremendous determination and calmness. At the same time, it keeps me a bit more detached from hurdles and setbacks.

I can see that you'll get there. You might be able to take on a bit of calmness and detachment by realizing that your battle and protection of your dad's interests are already done.

          After we get through this round, and I'm sure we will. I've basically got everything that taking Guardianship would include, without actually taking it. Our lawyer says that Judges Do Not Like To Do a Guardianship hearing because it is so final and can only be changed by another judge. Not like a Power Of Attorney, which is revoked by another POA or just plain revoked! He feels good about our situation because my Dad had shown his state of mind by realizing that he can't handle all the things that are needed to be done and has put me in the position that I can do what ever he can't. We haven't even actually been served yet and he is ready for them. They are going to have to run Dad down, to serve him. If they wait a bit longer, he won't even be where he is now! :D I have gotten it set up so I will be the one to pick him up and also, I've gotten the release from the nursing home and a place up here that will be really nice for him to be for at least a month and hopefully through the winter. He is just sitting on ready!

       Well, After a buddy and I made the trip down, saw my Dad and loaded up some of his furniture to take to Dad's soon-to-be temporary residence and got back up here, got the stuff faxed to her lawyer, gassed up my van, called my Dad to see how he was doing and found out that he'd been served. >:( He was obviously beside himself and I knew that I had to go back down there to help him feel better and not get all worried about it. Really makes me MAD when someone does something that upsets him like that. >:( >:( Might know that they'd serve him late in the afternoon on Friday! >:( SHE was up there earlier that day (probably to locate him because they couldn't find him. ::) If I'd have had a few more days, I'd have had him out of the county and at least 3 counties away! :D I DID manage to turn off their phones, w/o a penalty, by "Suspending the phones". Alltel was VERY helpful in taking care of this. We will have to pay the base rate but not the other charges (thought this might be helpful to others, at times). If I had gotten back home quick enough, I'd have gotten the Dish Network turned off too! I came home and had to go back so soon, I didn't get the Uhaul trailer unloaded to take back ( I only rented it for one day-24hrs) and my van has lots of stuff in it from the house and the Nursing Home (He has been checked out of there and I have told Dad that he won't be there. I don't see how in the world that any Judge (or her lawyer) could even think of allowing them to continue with this (much less WIN it), with ALL that has been done (I mean, you could say that I already HAVE Guardianship, except for the LEGAL title) to put everything in MY control (if Dad can't take care of things). If he DID lose and HAD to go back to the Nursing Home, It'd Kill Him and I just might not be here on the forums cause I'd be in jail for taking them out! >:( I'm telling you that I would be pretty distraught, if they won. I don't see how they could though and our lawyer says that Judges hate to do "Guardianship Cases" and when the Judge sees that my Dad had presence of mind to know what he wanted, knew that he couldn't do it alone and got me to help him get those things accomplished, that'll say alot.

            Now, to add to the load that my Wife and I share with ALL that we are dealing with, we got 2 stuffed envelopes from my Health insurance company that contained info from several places that have treated Karla (our Daughter, who had Medicare) and it shows the amounts f money owed to the Insurance company because they were filed as the "Primary", instead of Medicare. :-\ We had NO idea that Medicare was to be filed as the Primary because when Karla had Medicaid, my Insurance company was filed as the "Primary" and Medicaid was filed AFTERWARDS!  ::) We're talking more than $15,000 for sure. >:( By rights, Medicare should reimburse the Insurance Company. Fat Chance! Sure hope they don't mind payments and not very big ones at that! >:(

        We're ALL liable to be in that nursing Home, before it's over. :(

What a way to zip into a Sunday, Bill. I'm sorry to hear about the medical insurance problem. Of course, if they do pay, it'll take them a while. Medicare has been very helpful to me, but I'm guessing that I may be unique in that category. On the other hand, there are lawyers who specialize in Medicare type disputes. They get a contingency fee (I believe there is a maximum), so you won't need to lay anything out. With the figures you're talking about, it wouldn't hurt to try that direction if they don't pay.

       Well, I got some of the furniture in the Room that we got for my Dad to come up here to (for a while, at least), only to find out that the hospital won't release his records just yet (because of the "Guardianship Lawsuit")! >:( Don't know if that means I can't move him or not. ::)  I mean, it's not like he's a flight risk! :P  Hopefully, it'll be realized by their lawyer, that S & S are only after his assets cause everything's been done to make sure that his affairs are taken care of and he's covered from one end to the other. ;)  There ought to be a "Special Place In HELL" for those two, a Very Special place!

        On a good note though, after I went right back down there Friday evening and stayed til about 8PM Saturday night, he was feeling pretty good and we had watched some really decent stuff on TV, that was particularly good too! We saw some stuff on Arkansas Public TV. We saw some history on the Railroads of Arkansas and watched some refurbrishing of an old Steam Locomotive, watched a NASCAR Truck Race and a hours worth of Drag Racing on the Speed channel. He was in Real Good Form, when I left Saturday night and was about ready for some shuteye. ;)

         Sure do appreciate ALL the support from you all too! ;)

Just curious, but in order to get a guardianship doesn't a doctor have to actually see the person concerned?  I know that when considering that for an aunt my cousin and I were told that was the case.  Maybe I missed the post where it was mentioned that the doctor in question had seen your dad.

Anyway, just a thought.
