Well of course he couldn't read them.  But I'm tellin' ya, if I see a helmet go by with a bunch of those "clever saying" stickers on it, I'm betting that they're of the "thumb your nose at the man" variety rather than "Jesus saves" or "Have a lovely day".  :D  :D

The sticker on the outside means NOTHING.  The DOT certification sticker on the inside is EVERYTHING.  Most of the time, one has to lift the liner a little to see the DOT and ANSI stickers.  If these stickers are not there, pay the ticket.

Ask for a conference before the trial with the Cop, be polite. Show him the inner DOT tag and he can withdraw the charges. Break his balls in Court with no warning and you may find his brother officers in your back pocket. Be polite and you understand it was an error, no harm done.

If the conference works, there will be no Court washout. The Cop with draws the complaint.

I have a feeling that deliberately covering up the DOT sticker or taking it off for no real reason could get you pulled over and questioned. He turned around to follow her for a reason though, whether or not it was the helmet. Cops don't just spin around in the road like that for nothing. She changed how she was riding or something when he was behind her, because he waited for a while to pull her over. Then, in the end, she was ticketed for the helmet. But the fact remains, he picked her out going the opposite way for a reason. The ticket for the helmet is just what she ended up with. You can fight that one though. She needs to think closely on what would have gotten his attention in the 1st place, if it wasn't the helmet.  :-\

Oh my, but I beg to differ....I've had numerous cops, in different cities, whip right around in the middle of the street and chase me down because of the way I looked, backwards cap, long hair, goatee...stopped or going with the traffic flow... On several occasions, the very first thing the officer said to me, in front of my wife and two kids in car seats in the back, was "We can do this the easy way or you can go to jail right now". As much as you hear about "not profiling", everybody does it every day and it's easy to test if you don't believe. Put yer baseball cap on backwards and paint your car rat style, or ride a bob or chop and see if you don't get hassled two or three times as much as a guy wearing a $400 set of leathers on an new $20,000 sportbike doing the same stupid stuff on the road, or the guy in the Escalade, speeding, weaving in and out of traffic talking on his cell phone. Unfortunately, in my personal opinion, she got stopped because she fit the profile of radical teenager. And, while they say they don't have quotas for writing tickets, the more tickets you write, the better it looks on your next personnel evaluation, a girl is an an easy stop, most people pay the fine and he looks like gold to his superiors. The more you stand out from the crowd, the more likely you are to get noticed and when you get noticed, you are, as far as I can see in any aspect of life, evaluated on how you present yourself. Nice clothes, shiny car, well groomed (white) = successful, intelligent, respectable, and as those attributes lessen, so does your standing in whatever community, to then point where primered car/rat bike, raggedy jeans and sneakers, long/punk hair (black) = un-educated, welfare, druggies, out of control, slackers, trouble makers, generally, not someone you want living next door. The more you fit this end of the profile, the more likely you are to have already been thru "the system" and therefore receive more intense scrutiny and actual harassment.Truly race is more of a "color gradient" issue, but ask any non-white folks if this isn't true, and they'll also tell you that no matter how nice your clothes are, if you can't change your color to white, you're still gonna get hassled even within your own race, "If you're light you're alright, if you're black, better git on back". This is class/race "warfare" on the economic front, the more you look like you're at an economic disadvantage, or outside the "norms" of society,  the more likely you are to become even more economically/socially challenged. Cops are there to uphold the "norms" of society, the only thing she (or any of us) can do to avoid it, is to not attract attention by, in this case, A: riding a motorcycle, and B: expressing her freedom of speech. Doesn't matter what you're speaking out for or against, when you speak out, expect to be challenged, freedom has it's price.

 Or, maybe he thought she was hot and wanted to hit on her. Some cops do that....

if you go to court with the helmet,he could say that wasnt the one she was wearing?you could turn up at court with a brand new most expensive race lid anyway?i dont know ,its a little touchy,,like in court you have to question the officer and all?ide be pissed right off with this rubbish,,as posted before,maybe try and have a sort of "mediation"it does suck though,today i just took an exit off a freeway,the cop on a bmw bike who i hadnt noticed takes the same exit,im thinking now have i been going too fast and all that stuff,but he takes another turn and dissapears,he saw me alright,maybe he also saw my dot sticker?which i stuck back on at the start of this thread!!looks a bit wrong though.

In NYC they have a Motorcycle Squad who is tasked with enforcing the law on bikers. I met a guy who showed me a ticket for inadequate eye protection since he had his visor up and his sunglasses were not certified. I was stopped a the bottom of an exit ramp on my way to get an inspection, I was a couple of days overdue at the end of the ramp was the bike shop. It was a State Trooper and a local cop. I told them I was doing more restoration work and I had an appt at the dealer for the inspection. The local wanted to write me up, the Trooper told him no. It does pay to be polite.

Ontario has no requirement to have a DOT sticker visible. You can have a helmet approved by any number of agencies, I don't have the list but Snell is fine for example.
If you are stupid and wear a non-helmet no approval beanie hat instead of a real approved beanie helmet, the police can not make you take it off to show them the lack of approval tag or sticker inside. Lack of a helmet is a trivial offense and they can't arrest you for suspicion of having a non-helmet on. If you foolishly take one off and hand it to a cop you will get a ticket and probably have to leave the bike where it is (at least until the cops drive away).

I would say if you are wearing that helmet for anything other than just keeping the police off your ass it is time to upgrade! Helmets like tires eþc etc have a shelf life and it isn't 35 years lol...

Like I said, I didn't know if there were or not...just asked the questions....2nd, don't they wear 3/4 and not 1/2?  at least thats what I have seen on most...might depend on where you live though.

Some of the cops around here have 3/4 helmets but I seem to remember CHPs and other CA cops wearing 1/2s...easier to hear and speak with the "detainee" without taking the lid off...

Talk about a moving target to stay legal, here is the NY law:

FINE:

    Chapter 71 of the Consolidated Laws. Title III--Safety Responsibility; Financial Security; Inspection; Size and Weight, and Other Provisions. Article 9--Equipment of Motor Vehicles and Motorcycles. Section 381. Motorcycle Equipment. :

          ". . . 13. A violation of any of the provisions of this section shall be punishable by a fine not exceeding one hundred dollars or by imprisonment for not exceeding thirty days, or by both such fine and imprisonment."

STANDARDS:

    Chapter 71 of the Consolidated Laws. Title III--Safety Responsibility; Financial Security; Inspection; Size and Weight, and Other Provisions. Article 9--Equipment of Motor Vehicles and Motorcycles. Section 381. Motorcycle Equipment. :

          ". . . 6.. . .The commissioner is hereby authorized and directed to adopt regulations for helmets which are consistent with the requirements as specified in section 571.218 of the federal motor vehicle safety standards as may from time to time be amended. . . ."

          ". . . 9. It shall be unlawful to sell, offer for sale or distribute any goggles or face shields for use by the operators of motorcycles unless they are of a type and specification approved by the commissioner and appear on the list of approved devices maintained by the commissioner."

          ". . . 9-a. It shall be unlawful to sell, offer for sale or distribute any protective helmets for use by the operators or passengers of motorcycles unless they are consistent with the regulations of the commissioner as provided in subdivision six of this section and within the requirements specified in section 571.218 of the federal motor vehicle safety standards as may from time to time be amended."


I just bought a new Shoei visor.  I guess I should have called the Commissioner to see if it is on the approved list. ;D ;D ;D

This is an interesting thread.
I imagine your court date will probably be 3-4 months right?
In my experience most police officiers will not show up for a
minor traffic ticket, so definetly contest it.

Now if he had written you up for multiple violations he would probably show up at court.

we had 10 days to respond and had 3 choices admit responsability ,admit responsability w/explanation or
deny responsabality. . weve been told what they do up here is schedule as many hearings in a day for the police officer so hes not showing up (or not for one ticket ) weve been told once she gets a date to change it this makes it less eficent for the cops so instead of coming into the court for 20 hearings hed be making a special trip.
shes woried about the cop saying her helmet is not the one she had on that day
  we rode with some abate bikers this weekend & they say if we were abate members they would send a lawer & fight the ticket and win even if she didnt have a dot helmet  the guy telling us this was wearing a benie helmet & had just won a case for the exact ticket she got .
I went buy the same cop wearing my 35year old helmet and in a hurry he look up but stayed put, but when I came back he had a kid on a moped pulled over the  kid had on a stickered up 1/2 helmet I almost fell off my cb laughing so hard because i knew why he got pulled over

The cops have dashboard cameras.  It should be visible in the camera, especially with all the stickers.

Yep, motion to discovery of dashboard camera video if he tries to say that isn't the helmet you had on.
I doubt he would try and pull that though.
