Does the lawyer know about the abuse of your fathers good nature bill?
That may be a point that could help, the financial abuse they have put him through is NOT right and should be a useable item for any legal crap that is thrown about.

          Oh Yeah, he's very aware of that. One big problem is, my Mom and Dad had allowed him to do some much over the years, and I had no idea that is was going on. I'm sure that they were too embarrassed to tell me anything because there is a cousin (ADPOTED) in our family, that took his parents to the cleaners, financially and my Mom was always telling my brother and myself (on our way back from visiting my Aunt and Uncle) that she "Hoped and Prayed that we NEVER turned out like that!" I still don't know ALL that they have done for him and don't really WANT to know either. I'm not trying to play a "Catch Up Game" here, I'm just trying to set things straight, the way that Dad wants them. If I can get this thing settled and put the "Monkey On Their Back", that'll be great because the next step would be going to Court and THEY can't afford that without HIS money (I can't either).

I'm doing the best I can, to get things right and my family is helping in any way they can. I HAVE to get to the point to where I can spend some time on mu 80' 750K and get it finished, licensed and insured so I can come and go on it, to take care of things. When I leave home, my wife has no transportation and she needs it.

After hearing about the cousin, I'll bet you could go to the cemetery and hear your Mom whirling dervishly in her grave!  When this gets ugly(er), you might try reminding your brother of that cousin and the situation he caused.  It might not stop him, but it'll make him think for a second.  Especially if you invoke your Mom and remind him of her comment.

And a copy of her POA will go a long way to help you do some digging into her history and shed some light on the actual state of their marriage.

        Guys, just got word that MY Power of Attorney stands, over hers! ;) Also found out that she has convictions for hot checks (in at least 2 states) and criminal malicious mischief and destruction of property! Numerous traffic tickets and has an aka - Shanks. We're back up and running after feeling so devastated yesterday! Oh Glorious Day! Still have to do the revocation of her POA, even though we can't find where it was filed IF IT WAS AN ACTUAL POA AND NOT A FAKE!!!!!!! Updates, as they happen. 8) ;)

You don't HAVE to file a POA.  It is a good idea, but isn't required.   Good luck,  can't wait to see this fixed

            Thank you Dennis, things DO seem to be looking and going the way Dad wants them. I've thought that several times before and was shot down. This time seems to be better though. We've got a better idea of what's going on and, hopefully, are on the way to getting full control of the whole nine yards FOR my Dad. ;) 

             Dad's doing pretty good, all things considered. I'm going to  Little Rock tomorrow to see about the letter that will revoke her POA  and take care of some details on his bank account to help get things closer to being finished and, hopefully, over (as far as my brother and his wife are concerned. ;)

          Yeah, it's ALL because YOU weren't here to keep things under control! :D You DO know I'm kidding you Tim. ;) Seriously though, it's been  an experience that (once it's over) I hope I never have to experience again! :-\ My Dad wants my brother AND his wife COMPLETELY GONE and NEVER wants to see them again. He is totally and completely disgusted by the way they have done him AND me. He us fully aware that I am only out to help him in any way I can, to have a more peaceful life.

          Now, I'm finding out that a POA doesn't have to be filed, but It's out there for all to see what you've got going though. I'm not saying that everyone who doesn't file them, is trying to sneak around and do things they shouldn't, but People like them (my brother and his wife) do it that way so they won't be easily discovered.

          Thank you for your support and good wishes, This is one project I will also be glad when this part is over and then we (especially my DAD) can get on with our lives. ;)

         Yeah Chris, with family like this, who needs enemies! I really don't expect to much out of this from them, after we get the Order of Revocation done, because the next step should be going to court and THEY don't have any money of their own. ;D Even after things are completely in place, I still have a lot to do. There are the bills to pay, finding out which Doctors he sees (and REALLY needs to see), setting up "Home Care" (after he comes back to his home) or a decent Nursing Home (if he can't go to his home, Heaven forbid).

          Thank you Paul for your thoughts, here's hoping that we are on the downhill side of this. I may be wrong, but I expect the next problem we will face will be to go and get total possession of my Dad's home (I'll be changing all the entry door locks, disabling the garage door opener and changing the door locks on the boat house (I'll be going to the house with a Sheriff's escort BTW, in case my brother is there and/or has changed the door locks already) When we DO go for the home, I'll also be looking to get my Dad's vehicles back and whatever else my Dad can prove is his. There are things that my Dad and I felt should go to my brother, upon my Dad's death. Now, however, my Dad says he gets NOTHING!!!!!! I can't blame him. My Dad still talks about "Disowning him!" But now, I can't disagree with him. My wife and I feel like that, when this ALL comes down, my brother's wife will probably leave him, and would probably leave him anyway.

Her leaving might be the best thing to happen to him.  Who's to say she isn't the driving force behind his behaviour?  It does sound like he has had these tendencies since his early teens, but it takes big brass ones to go as far as he has, and it wouldn't surprise me if she wasn't prodding him with a sharp stick or something

well Bill, theres good and sad news here. GREAT that you finally seem to have your brother and his wife out of the picture and sad for the alzheimers. if you ever need to know about alzheimers or need someone to talk to about it i'm here for you. we had my mother-in-law stay here with us when she was diagnosed rather than send her to a nursing home and we saw EVERYTHING that could possibly go on with an alzheimers patient. a good home care nurse will be your best friend you'll find.

       333 & fuzzy, I'll try to get to your replies either later tonight or maybe tomorrow. ;) I've just gotten back from where my Dad is and you won't (well you might) believe this!


        I arrived at the Courthouse today, to be immediately told by one of the clerks that my brother and his wife had files "Probate". They were going for Guardianship of MY Dad! >:( >:( >:( >:( >:( I was flabbergasted, to say the least. The Case was heard this morning, before I even got there! >:( >:( >:( >:( >:( . It was recommended that I go see their attorney, talk to her and show her the "Dirt" we had on her (thanks to my wife hiring an investigator). So, with a mighty heavy heart, I went. :'( When I got to the Courts Bldg, I went in and sat down. After only about a minute or 2, this lady sitting at the back of the room (and on the other side of the door), motioned for me go g outside with her and I did. When we got outside, She said, "You must be Bill" and I said yes, I'm the OLDEST son! I was holding some papers and a spiral notebook (with the dirt on my brother's wife) Before I could say hardly anything, she informed me that she was going to ask the judge for a dismissal! :)  Then, I asked her to look at the page I had opened to (in the spiral). She read the DIRT and asked if she could have a copy   and I obliged her. So then, as I was heading back to the Courthouse to try and find where a Notary Public might be, I was called by the Nursing Home about an appointment my Dad had and was I going to be taking him? Of course I agreed and we set it up for me to pick him up when the time comes for that. I went to the Nursing home to see my Dad and find out how he was doing. He was in therapy and was doing quite well. Then I asked the Lady in charge, about a Notary and she said they had one. But, when she checked, she had gone for the Day! ::) So, I went back to the Courthouse (my lawyer, in a conversation with me Friday, told me to look for an insurance agent or a Realtor) to find a notary. I went there and asked and one of the clerks took me outside to show me a Shelter Insurance agency a half block away. I took off. I went in and everything went well until I found out that she would need a photo ID. My brother's wife has his billfold (with his license in it). Once again, I was sick! :(
Then, the young lady told me to call the nursing home and ask if they had something like that. I figured it was a lost cause, but I called anyway. :( They didn't think they did and all of a sudden, one of them said they thought that they made a copy of his driver's license and, sure enough, they DID have it! :o Man, the lady and I went to the nursing home, went to my Dad's room, took care of business, I went to the courthouse, filed the papers (revoking "ANY and ALL previously filed General and Durable Power Of Attorney's)!  Then I filed the NEW Durable Power Of Attorney that my lawyer had made up to start fresh with. I then proceeded to the Bank and the Nursing Home and leave them each a copy of both documents! ;)
I got a phone call earlier (a bit AFTER the "Dirt' info was given to the other lawyer) from my brother's number and I don't know which one was actually calling me, but I didn't answer it. That was the last time for that! All in all, this has been quite a "Roller Coaster Ride" and one I don't care to have again. My wife called while I was with my Dad and when I told her that our lawyer said that getting "Guardianship" was about the only way to stop all this for sure, my Dad was right there hearing it all and then Dad said that, if my having guardianship over him was the only way, then GO FOR IT! Now, that IS sad, but he knows that I wouldn't interfear with his business, unless I needed to! I can tell you that it has been an exhausting day, to say the least! Still got things to do, it ain't all over yet!

It is really sounding like shes the driving force behind this entire mess...just a thought...perhaps you may need to get a sheriff to be on hand to get your dads billfold back...thats really freaking low for them to have that too.
