Yeah Bobby, his back is out and the headaches are ever present, he just can't sleep and he is having to take way too much pain medication (of which he needs to get a prescription or 2 if he doesn't already have them. Just because you have a prescription doesn't mean you HAVE to take them but you can't 'theoretically' take them unless you have a documented prescription)  ;) It's really hard to function and work or drive with all those narcotics in his system too. It's a good thing the narcotics help ward off some of those nightmares of the wreck he has been having every night!
As of today 3/13/2012 my original owner 75 CB750F has made it through 3 wives, er EX-wives. Free at last.  ;-)

You need a lawyer who known motorcycles and has won cases for motorcyclist. Insurance companies and their adjusters are NOT your friends. They will try to minimize the exposure and loss anyway they can.
Your body kit will probably cost 2x what you paid and the paint work more than you originally guesstimated. Then there are the other parts that take time to track down and restore.

Pain and sufferring and the loss of wages...
If you have a family, there are losses incurred by things you couldn't do that you would normally be able to do...be it for your wife or kids, or heaven forbid as a caregiver for an aging parent...

It is a slippery slope...

I've got it all covered.  No need to sue if you understand how it works.  Lawyers are scum(unless they belong to SOHC4 or VJMC) and I have no desire to make one richer.  I've been down this road before.  I do however appreciate everyone's comments and interest.  I'll keep you all posted.

Otherwise the insurance company will assume you are a rube and treat you as such.
I am the first one to admit I hate lawyers too as an engineer but recognize their place and need in certain situations.
Even if this never goes to trial (and that company does not want to go to trial if they know their insuree was at fault) you still will need an ambulance chaser to let them know you mean business.
It is unfortunate you will have to do so but it is the only way they will take you seriously and make sure all the necessary paperwork and medical papers are secured to make sure you extract the maximum amount of money from the insurance bloodsuckers.

You will be really doing your case a disservice if you do not secure an ambulance chaser at this time.

No calling it totaled, no salvage title, no asking me to sign off on the personal injury claim.  The hospital however refused to send me a bill, called repeatedly then after only three weeks sicked their lawyers on me with letters and phone calls saying that I had been refusing to return their calls etc.  I hired my own attorney who pretty much fixed the whole situation with exception of my right knee which has a torn ACL.  Which brings me to why I haven't posted much or updated this particular thread.

  On May 23, I was on my CB360 headed to see an orthopedic surgeon and a pedestrian stepped out in front of me.  He was cutting through traffic that was backed up to make a left turn, looking at his phone and he stepped right out in front of me.  Less than a car length to react, I dodged left and if he had kept moving, I'd have missed him.  Of course he froze and I ran right into him.  His tib/fib were shattered, facial injuries, and somehow he ended up under a parked car.  I was thrown off and tumbled/slid across the road.  My C3 vertebrae was broken, my cervical spinal cord was bruised and it swelled up causing me to be paralyzed from the neck down.  I had on all of the right gear so my head didn't get busted open, no road rash, no other broken bones.

wow I am really sorry to hear this. I really can't find the words to have even an idea of what you must be going through. We all may be mostly strangers on this forum, but we are family, and we are all here to help you, any way we can.

I'm doing alot better.  Actually I had written out a full description of my current condition but somehow the last paragraph didn't post.  The quick version is:


I was in the hospital for 2 months
I'm walking with a cane.
I can drive
My hands work but the left is lagging behind.
I have frozen shoulder syndrome in my left shoulder (fixable/temporary)
I have muscle spasms and neuropathy
I can't work
I do PT 3 times a week
I wasn't cited in the wreck, the pedestrian WAS
cited
The pedestrian had a liability insurance policy
My lawyer is working on it.

Today is a year since my crash.  Mark, thanks for asking about the bills thing.  Medicaid paid for all of it.  I have an insurance check coming and when that comes in Medicaid gets paid back first.  The lawyer takes the money off the top.

Sorry I missed the updates on the thread. I am glad you are doing better and you have a settlement that is paying the bills.  It really bites when things happen outside your control that put you through emotional and physical tramau and can ruin your life. Having hospitals or insurance companies be inhumane just adds to the bull on top of the injuries.
Are you healed completely or still dealing with issues?
Never thought about pedestrian issues too much and liability insurance for those instances.  How many people would have coverage for when they were a pedestrian? Not as common a problem or situation.

Hopefully,  your settlement in a year indicates no lasting damages and you are healed and doing well.

RAF I'm doing pretty well.  I walk all f**ked up but that's getting better.  My left arm and hand have both just now started responding to the work I've been doing.  I'm just a hard headed hillbilly with a 1100sq ft of shop space and obligations.  I could've laid down and died in the street but daddy didn't raise a quitter.
