It is really sounding like shes the driving force behind this entire mess...just a thought...perhaps you may need to get a sheriff to be on hand to get your dads billfold back...thats really freaking low for them to have that too.

       Pretty soon, I'm going to approach the Sheriff"s office about my Dad's house, his van, billfold, the box with the deeds, titles and such.
First, I want to be as sure as one can be, that my Dad IS safe from them. Then, I will be talking to our lawyer about my rights as far as taking back the house, changing ALL the locks and disabling the garage door opener of my Dad's place. I hate to think about families breaking up, but he WILL NOT STOP, unless HE'S STOPPED!!!!!!!

You should report any credit cards in the billfold as stolen.  That way, if they try to use the numbers in the future, or if they already have, they could be prosecuted and Dad won't be liable for any charges.

bill, i feel frustrated and angry about this situation, i feel animosity towards your brothers wife and i am not even part of the goings on there. best of luck to you my friend. i hope the vultures lose .

          Thank you fuzzy, seems like everytime, I've done something, the counter with something else. >:(  I think ( I hope AND Pray) that we've finally got an upper hand on this. They tried to have him found incapacitated and get guardionship over him and their lawyer backed out and had the case dismissed. Now that I have the Revocation on file, to supercede ANY ANd ALL Previous General and Durable POAs, my Lawyer said to mail her a copy so that she will know first hand, what's up! She's also got his checkbook, but she should be out f checks, I found an empty checkbook pad on my Dad's table. We are going to be keeping an eye on the canceled checks and if there are any that were written after I took over on the accounts and report her to the authorities. Might just add some things to her record. I sure hope things are slowing down, I'm really getting tired and I can't stop because I have to help my Dad ALL I can. ;)  date=1218083074]

If i were you i WOULD do the guardianship thing, for your peace of mind and your fathers welfare and safety.

        Things seem better but, I can't help being a bit edgy still yet. I really hate to have to go the "Guardianship thing". I mean THAT is what this whole thing is about! That and GREED!! Although my Dad said, if it'll STOP them, then DO IT!!!! I immediately told my Dad that it would only be as a last resort and, as far as I was concerned he would still be in control as long as he was able.

     My brother already had the "Greed", she was like the "Motivator" and I figure that's why he married here in the first place. And I HAVE to tell you that she is PURE UGLY!!!!!! She didn't get whupped by the ugly stick, she was attacked by the WHOLE FORREST!!!!!!!!!
I figure IF one of them got more than the other, there would probably be a fight! :D But, more likely, if she got the money, she'd probably leave my brother.

       My Dad, for all practical purposes, is the last living member of my original immediate family. I love him very much, have the greatest respect for him and he IS my Dad! ;)

        Thank you for your concern Tim. I'm trying to take care of myself. I actually AM frazzled and tired. I've been back and forth several times now, racking up about 1500 miles on my van and seems like about 25,000 on my body. And I don't even want to talk about the stress factor. I just do alot of running (back and forth), alot of Praying and alot of inquiring about what I can do!

         Yeah, I wish it was that easy that you all could just package up some good sleep and peace of mind and send it on to me.

         There Have been several times that I have just about Flipped Out! I just can't even think about relaxing until I know that there is nothing else they can do.

          I WILL do my best to stay healthy, cause I've got my Dad and my family to be there for and, I have to get back to motorcycling, don't ya know. ;)

                       Tim, thank you (and all the others) for your continued support, info and comments. It all helps!

           Well, the thing is, I have to get back in that house (if they haven't changed the locks) and get the statements, so I can get account numbers and such. If they HAVE already changed the locks, I'm going in with a Sheriff's escort and take back the house because we (Dad and I) have already executed and filed a new deed that is written such that the home & property us listed that if one of us dies, the other one retains total ownership no matter what  (will, or what ever doesn't matter) The bank is changing his account number, in case she has checks that we don't know about. It's pretty tough to be a one car family, have the commitments that we do and try to take care of a situation like this. But I'm going to do the best I can (and I have my wife's full support and assistance, where she can) to get things taken care of for my Dad. ;)

damn bill, would the loan of a second small car help you at all? my saturn is super high miles but solid, reliable with working a/c with the bike all but done i can do without the car for a while till you get this mess worked out.

       As of yesterday, we have a letter to revoke all previous General and Durable Power of Attorneys & then, a current Durable Power of Attorney filed, in the process of changing the bank account number, mail is being held for me, the Rehab/Nursing Home calls ME about things concerning my Dad and I've been contacted by 2 Doctors about upcoming appointments. Going to be more stress getting things (Dad's business) sorted out so we can deal with it and all, but at least it's a more welcome stress than what we HAVE been dealing with. ;) Dad told me yesterday that because of my efforts, he's able to sleep more peacefully and not be worrying so much. I can't tell you all how much that means to me. He is SO upset with my brother and his wife, he is wanting them COMPLETELY out of the picture AND wants to talk to the lawyer about "Disowning my brother". Now, when anyone says anything about how many sons  does he have, he says ONE! Now, at first, I talked to him about that and now (after the latest round) I have told him that the choice is up to him and it's final. He says he know that and still wants him gone because he will NEVER stop trying to take over. It's really a sad thing, but my brother has crossed the line a long time ago.

          BTW, my Dad hasn't seen them since she took him to that Rehab/Nursing Home and I've only had them (or at least one of them) try to call me one time on Wednesday! Of course, when I saw the phone number, I ignored it.

          Also, thought you all would like to know that my Dad seems to feel better and looks a lot better now. 8) ;)

        fuzzy, forgive me for not responding to this earlier, I didn't mean to neglect your post.

        Thank you for your kind offer, I'm hoping to get things squared away here before long, so that I can get my Dad's van back and be able to use it while my Dad is out of pocket (so to speak). I have to see if the Rehab/Nursing Home has any projected release date for my Dad. He and I both are looking forward to him being released from there. Now, IF it looks like he's going to need to be in a place like that, I'm going to try to get him to check out a couple of places up here where we live, that look to be really nice places. He's resigned to the fact that he could at some time, need to be in a place like that and I think it's because he knows that I'm not having him in one, unless there is no other way! But, from what I've seen, he seems to be coming along quite well. ;) Even if he can't drive himself, we'll make sure that he gets to where he needs (or wants) to go and do it without taking anything away from him, dignity wise! I can't say that about my brother and his wife, they can't get away from FISHING long enough to do much with my Dad. Kinda hard to be very outgoing and very alert, if you only see someone at lunch time, when you are picked up for appointments (which you don't find out until just before you are to leave) or to bring you the food (improperly prepared and arranged on a plate with foil over it and placed in the freezer until you are ready to warm it up and try to eat it) that you are supposed to eat. >:( Until now, my Dad's everyday life consisted of:  Getting up around 9AM, breakfast (Malt- O-Meal or something similar), watch TV or play solitare on his computer (he has no desire to go online), be picked up for lunch, eat lunch out, come home, watch TV or play solitare on his computer, decide if he wants to try to eat one of those "Plate lunches" for supper, watch TV or play solitare on his computer go to bed at 10PM and start all over again the next day! ::) The biggest difference was Wed. night was Church and Sunday was Church as well. No conversation, nobody just visiting, NOTHING!!!! The times I've been able to go down, he doesn't take long to warm up and do very well with conversation and seems to really liven up. I have to tell you that there were sometimes, when I was leaving there, he would just stand there at the door and had a look like his life was leaving. :( It really killed me to have to leave him there like that. :( It doesn't really take much to give him pleasure, you just have to take a little time and that's all. He seems to be holding up pretty good now, cause I think he knows that I'm managing to be there off and on and trying to take care of getting his affairs in order. ;)

I really appreciate that and I believe you would be here, if you could. I've no doubt about that. It's like when dust hawk was really down sometime back and thought he was going to have to sell his bike (Rita). Some of us helped in one way and some were actually able to be there to give him a hand and that was cool to see the way folks joined together. Now, don't get me wrong, I'm not asking for anything like what Jeff (dusthawk) needed. The support I've gotten here, the input, the suggestions and the fact that some others have shared their experiences here, might have helped them to cope with things better and allows all of us to see that we aren't the only ones with these types of problems. It truly DOES help to be able to have a place that I can unload also. Sometimes, my plate gets so much on it, I feel like I need something like 4' sideboards n it to keep things from falling off.

           I would love to get some rest, but I can't get much cause my brother and his wife have been busy trying to figure out how to get and keep control of my Dad, put him in a nursing home and getting access to his checking account, savings account and CDs I'm afraid to relax too much because they might come up with another way to get back into the position of controlling my Dad. Dad is saying, in a pretty strong voice, that he wants both of them COMPLETELY out of EVERYTHING and wants to "Disown" my brother!I tried to discourage that, but my brother and his wife just keep on trying things. So, I'm on my Dad's side on this, my brother has made the decision to attempt to put Dad in a nursing home and get control of his assets and I'm doing my best not to let that happen. :P

Wish iwas closer and able to help mate, you need more than words right now...
You said your father is your only family relative and that your father wants to disown your brother, cant you get some sort of restraining order against them, with the history of #$%* they have done to your father i`m sure his lawyer can sort something out..
Didnt you mention something about your father having a lake cabin or something?
Why not take your family (including your special needs family) and your father and have a special fmily get together for a few days or a week, i reckon that will be the healthiest thing you guys will have done in ages.

Wish iwas closer and able to help mate, you need more than words right now...
You said your father is your only family relative and that your father wants to disown your brother, cant you get some sort of restraining order against them, with the history of #$%* they have done to your father i`m sure his lawyer can sort something out..
Didnt you mention something about your father having a lake cabin or something?
Why not take your family (including your special needs family) and your father and have a special fmily get together for a few days or a week, i reckon that will be the healthiest thing you guys will have done in ages.

           Yeah, I'm looking at doing a restraining order on both of them. Getting ready to go the same route with the deed (which will add my name with my Dad's and if one of us dies the other one retains FULL ownership) of the property that my brother and his wife live on and then have then EVICTED, also getting ready to cut their phones off (they're on Dad's account. We know there will be a penalty, if still on contract, and Dad doesn't care), Dad also wants to talk to the lawyer about going through the procedure to "DisOwn" my brother. He is already telling that he has only one son! I wish he didn't feel he had to do that.

          Now, let me tell you what I found out today! I asked if my Dad was in there for rehabilitation and be released upon completion of being rehabilitated OR was he actually a Resident of the home and receiving rehabilitation?   Are you ready for this??

        They (my brother and his wife) put him in their as     

                           LONG TERM >:( >:( >:( >:(

         They had also requested that NO info be released to my Dad's Family Doctor. Both of them had had run-ins with Dad's Doctor and couldn't get him to cooperate with them. Well, guess what, I had that request tossed out and Monday afternoon, the paperwork will be ready for me to review and sign, to actually have him admitted there to receive rehabilitation, be evaluated and released to go home or go with me to a very nice retirement home about a half mile from me and will get mighty tired of me because I'm going to be there every possible chance. Of course, the decision will be up to him, if he's able to make it (and he should be able to).
 
         I'm hoping to be able to wrap this part up in a week or 2 and concentrate on getting his bills together, take care of them and getting things more under control, so my Dad can relax and enjoy life. Right now, he's like to use my brother for target practice!

Can't this all be avoided by getting a "living will" at the get go ?

I know "I" am given these rights for my Father by some paper work he set up some time ago.

Man, I can't imagine that much drama in my life every day :'(  Hang in there Bill ;D
