Someone turned left in front of me, question about attorney.

As the title states I was on my CB750 café bike, leaving work on a single lane road. I don't remember a thing, from what I can gather somebody turned left in front of me. I have liability on my bike, but I'm under the assumption at this point that it is not my fault.

The bike is destroyed, i'm beat up bad with fractures in my neck. I feel like it's me against the insurance company at this point, them obviously with the upper hand. It's been about four days without much forward momentum. I'm in Los Angeles, I was hoping somebody could give me a little bit of advice on how to proceed. Maybe A good attorney?

A phone call will usually get stuff going and done quickly. Expect to pay them a good 30% of what you get.

I'm not an ambulance chaser, I just want what's fair, I will be out of work for what appears to be a month or so. Is it worth calling an attorney.

Was a police report filed?  Were there witnesses? Without those two things you may have a difficult time, but glad to hear you're still with us.

There was a police report filed, I haven't seen it yet but a caption was read from it by the insurance company. Some random person that answered the phone at farmers, i'm guessing she shouldn't have read it to me haha. It says the vehicle turned left in front of me, I honestly don't remember a thing. I woke up in the hospital, couldn't even remember who I was for two days.

Cops will need to assess blame, usually a percentage - almost never 100% 1 vehicles fault.  Once that's determined you'll have more footing on which to proceed.  I'd get a copy of the police report.  Where'd you wreck? I'm in North OC/South LAC.
My neighbor's son died in a motorcycle crash - other drive was at fault - and they still haven't settled everything, that was a number of months ago.  So, I'm saying, be patient if you can.

Yes, get an attorney.
Some attorneys specialize in moto v auto.  Many of the mva attorneys are riders too.
You are also priveledged to contact the responding officers and ems personally.

Unless you were somewhere you werent supposed to be or riding in a way you ought not.  There is no reason to not sue the motorists insurance company for all their policy is worth.
Aim high. 
Your cafe racer bike is worth $9000 according to ebay.  Get back lost wages for the Missed work and all the missed overtime opportunity too.  Life and limb damages for your neck, and may as well fight for the future pain of follow up care.  Count the amnesia as proof of brain injury and get some pain and suffering compensation for the absolute scare of realizing you forgot your own name.

You have every right to make this insurance claim.  Know those rights, don't be a sheep. 

If the cager was uninsured, contact your local hells angels

Choose an atty who specializes in motorcycle accidents/injuries
They will help you determine what is fair based on damages, injuries, and any long term effects.... and can build their costs on top of it, help obtain all documents, reports, witness statements, etc.
Let them do the work for you while you recover.

There's a police report and a claim filed with the other person's insurance company. Everything was recorded, I just don't remember.

I agree with everyone else about getting an attorney. When it comes to paying out claims there is no such thing as being treated fairly by an insurance company. Shoot high on settlement because you can back down but cant go up.

The bike is gone, but it is just a machine. Your biggest concern is current and future medical and rehabilitation, don't let them jack you around on that part.

+1 also on being around still! Keep us posted as to how it works out for you and have a speedy and complete recovery.

 The insured's agent will try to get you to settle by not paying your bills and dragging feet. A good attorney will protect your rights. The problem is getting a good one, maybe a motorcycle association can make a referral?

Good to hear you are still with us. You can expect the insurance company to drag their feet and probably call ;you trying to get yo to admit you were to blame, (that's what happened to me). Do NOT talk to their insurance people, ever. Let your lawyer do the talking.

A friend's claim took 5 years to settle. Sometimes you have to wait....

The most important thing is you are still posting. STFU first. Document your damages. Record and keep a log of every letter and date and phone call as they  already started to scheme their fraud. Save the envelopes of each letter as when you finally get to a federal case your pleadings will be able to meet fed rule 9 conformity for well pled fraud accusation.  They will try to perpetrate a fraud and you need to document all mail and log all phone calls and record then if possible. Including your own attorney.


Make it a federal case ASAP, but that takes $75k minimum first so wait 'til you have projected medical costs present and future, unfortunately you might have to talk with a real litigator about this. Finding a real litigator is costly and the field is full of real  con men. Don't trust the guy you trust that says he is that.

Realize that the courts are the biggest fraud, but as much as they all  lie, their lies are only a trespass on the court (here anyway)  and that the Court really doesn't care about liars unless it's you, so always be truthful. They will put you in jail if you lie

Consider this your chance at treble damages, and that if it actually goes to court (collectively the biggest racketeering enterprise ever) it will be your chance to cull the herd of attorneys' being released on the court system that is significant enough to drop bar scores by 10% in the last ten years.

 If you keep a log book of conversations and the things that have happened, note the time, date, names and believe it or not, the weather and what happened that day. A hard cover notebook is better evidence because it can't be edited page for page. That all just proves it's real.

Download a recording app. Record your conversations with their insurance. Make sure you let them know they are being recorded, dependant on the laws in your state, and the state the insurance guy you are dealing with is located.

Some states both parties must be aware that the conversation is being recorded, some states only one (you) must be aware.
